END USER LICENCE AGREEMENT FOR "FIRST CONTACT"
IMPORTANT: PLEASE READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE CONTINUING WITH THIS PROGRAM INSTALL.
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity), and the author of this software, Haguy Eis ("EIS INTERACTIVE") for the EIS INTERACTIVE software product(s) identified above ("SOFTWARE PRODUCT") received with your order of the SOFTWARE PRODUCT.
Your use, distribution, or installation of this copy of the SOFTWARE PRODUCT indicates your acceptance of this License. If you do not agree to any of the terms of this License, then do not install or use this SOFTWARE PRODUCT.
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
EIS INTERACTIVE expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is provided 'As Is' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, non-infringement, or fitness of a particular purpose. EIS INTERACTIVE does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links, or other items contained within the SOFTWARE PRODUCT. EIS INTERACTIVE makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, malware, or other malicious computer programs. EIS INTERACTIVE further expressly disclaims any warranty or representation to Authorized Users or any third party. The user must assume all risks of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
The SOFTWARE PRODUCT is for personal use only and may be installed and used by only one computer. Its parts may not be separated for use on more than one computer. All components accompanying the software are copyrighted by EIS INTERACTIVE and may not be taken apart, modified, used or published with other software or means except with the software of this SOFTWARE PRODUCT and may not be distributed or copied in any manner.
In no event shall EIS INTERACTIVE and its owner be liable for any incidental, consequential, punitive or any other damages (including, without limitation, lost profits, business interruption, or lost information) relating to the use or inability to use the SOFTWARE PRODUCT even if EIS INTERACTIVE has been advised of the possibility of such damages. EIS INTERACTIVE shall have no liability concerning the content of the SOFTWARE PRODUCT or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of life, loss of privacy, moral rights or the disclosure of confidential information.
In addition, in no event does EIS INTERACTIVE authorize you to use this SOFTWARE PRODUCT in applications or systems where the SOFTWARE PRODUCT's failure to perform can reasonably be expected to result in a physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold EIS INTERACTIVE harmless from any claims or damages relating to such unauthorized use.
This agreement constitutes the entire statement of the agreement between the parties on the subject matter and merges and supersedes all other or prior understandings, purchase orders, contracts, and arrangements.
EIS INTERACTIVE is the owner of the copyright of this SOFTWARE PRODUCT, all of its derivatives, title, and accompanying materials are the exclusive property of EIS INTERACTIVE. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by EIS INTERACTIVE. You may not rent, lease, transfer, modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on this SOFTWARE PRODUCT. You may not make access to this SOFTWARE PRODUCT available to others in connection with a service bureau, application service provider, or similar business.
You may not disclose to other persons the data or techniques relating to this SOFTWARE PRODUCT that you know or should know that it is a trade secret of the EIS INTERACTIVE in any manner that will cause damage to EIS INTERACTIVE.
This SOFTWARE PRODUCT and all services provided may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data, or material in violation of applicable law is strictly prohibited. This includes, but is not limited to, copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statutes. You agree to indemnify and hold EIS INTERACTIVE harmless from any claims resulting from the use of this SOFTWARE PRODUCT, which may damage any other party.
The story, all names, characters, and incidents portrayed in this SOFTWARE PRODUCT are fictitious. No identification with actual persons (living or deceased), places, buildings, and products is intended or should be inferred.
