End User License Agreement ("EULA") for Guardians
This End User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity, referred to hereinafter as "you" or "user") and Born2Play Games (“the Company”), concerning your use of the “Guardians” software application (“the Software”) available on the Steam platform.
License Grant: Subject to the terms of this EULA, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on a personal computer or other devices supported by the Steam platform.
Usage Restrictions:
Modification and Reverse Engineering: You may not modify, translate, reverse engineer, decompile, or disassemble the Software or create derivative works based on the Software.
Unauthorized Distribution: Renting, leasing, lending, selling, redistributing, or sublicensing the Software without express written permission is prohibited.
Exploitation: You may not exploit the Software in any unauthorized way, including, but not limited to, by trespass, cheating, or overburdening network capacity.
Ownership and Intellectual Property: All titles, copyrights, trademarks, and other intellectual property rights in and to the Software (including but not limited to any images, photographs, animations, video, audio, music, and text incorporated into the Software) are owned by the Company or its licensors.
Updates and Upgrades: The Company may, at its discretion, provide updates, patches, or upgrades to the Software. These may include bug fixes, enhancements, new features, and modifications. Such updates will also be governed by this EULA.
Data Collection: The Software may collect and transmit non-personal data about your usage to help improve the user experience and for diagnostic purposes.
Termination: Without prejudice to any other rights, the Company may terminate this EULA if you fail to comply with its terms and conditions. In such event, you must destroy all copies of the Software and all of its component parts.
Disclaimer of Warranties: THE SOFTWARE IS PROVIDED "AS IS" AND WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE COMPANY DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED.
Limitation of Liability: IN NO EVENT SHALL THE COMPANY OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER.
Governing Law and Dispute Resolution: This EULA is governed by the laws of Turkish. Any dispute arising out of this EULA shall be settled through arbitration in Turkish jurisdiction.
Amendments: The Company may revise and update this EULA from time to time. Your continued usage of the Software after any changes mean you accept those changes.
Entire Agreement: This EULA, along with any other agreements or terms included by reference, constitutes the entire agreement between you and the Company concerning the Software.
By installing, accessing, or using the Software, you acknowledge that you have read, understood, and agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install or use the Software.
