IMPORTANT: PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THIS SOFTWARE.
1. License
1.1. By receiving, opening the application, and/or using Orbital Strike VR ("Software") containing this software, you agree that this End User User License Agreement(EULA) is a legally binding and valid contract and agree to be bound by it. Your use of Orbital Strike VR indicates your acceptance of this license agreement and warranty.
1.2. Subject to the terms of this Agreement, Draconis Interstellar LLC grants to you a personal, limited, revocable, non-exclusive, non-transferable and non-assignable licence to display, view, download, install, play and use Orbital Strike VR on authorised devices/platforms. This agreement is a binding legal agreement between Draconis Interstellar LLC and the purchasers or users of Orbital Strike VR.
1.3. You must be at least 13 years old to use the Orbital Strike VR or Orbital Strike VR online services. If you are between 13 and 18, please ask your parent or guardian to review and approve this Agreement and to supervise your use of the Orbital Strike VR.
1.4. If you do not agree to be bound by this agreement, remove Orbital Strike VR from your computer now and refund the game via Steam's automated refund process or contact Draconis Interstellar LLC by email for a refund.
1.5. Orbital Strike VR and the license herein granted shall not be copied, shared, distributed, re-sold, offered for re-sale, transferred or sub-licensed in whole or in part.
2. User Agreement
You shall use Orbital Strike VR in compliance with all applicable laws and not for any unlawful purpose. Without limiting the foregoing, use, display or distribution of Orbital Strike VR together with material that is pornographic, racist, vulgar, obscene, defamatory, libelous, abusive, promoting hatred, discriminating or displaying prejudice based on religion, ethnic heritage, race, sexual orientation, gender identity, or age is strictly prohibited.
The assignment, sublicense, networking, sale, or distribution of copies of Orbital Strike VR are strictly forbidden without the prior written consent of Draconis Interstellar LLC. It is a violation of this agreement to assign, sell, share, loan, rent, lease, borrow, network or transfer the use of Orbital Strike VR.
3. Limitation of liability
3.1. ORBITAL STRIKE VR IS PROVIDED TO YOU ON AN "AS IS", "AS AVAILABLE" BASIS WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE ORBITAL STRIKE VR WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE GAME WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. DRACONIS INTERSTELLAR LLC, ITS AFFILIATES, PARTNERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE OR HARM OF ANY KIND ARISING FROM THE USE OR INABILITY TO USE OR 'LOSS' RELATING TO THE ORBITAL STRIKE VR.
3.2. OUR LIABILITY CAP. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU IN CONNECTION WITH ORBITAL STRIKE VR OR THIS AGREEMENT EXCEED AN AMOUNT EQUAL TO THE AMOUNT YOU HAVE ACTUALLY PAID US (IF ANY) IN CONNECTION WITH THE MATTERS UNDERLYING ANY CLAIM(S).
3.3. YOUR INDEMNITY TO US. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS ON DEMAND DRACONIS INTERSTELLAR LLC, ITS AFFILIATES, LICENSORS AND PARTNERS FROM ALL LIABILITIES, CLAIMS AND EXPENSES, INCLUDING LEGAL FEES, IN CONNECTION WITH ANY ALLEGED OR ACTUAL BREACH BY YOU OF THIS AGREEMENT. IF CLAIMS ARE BROUGHT AGAINST US, THEN YOU WILL COOPERATE FULLY WITH US AND WE RESERVE THE RIGHT TO TAKE OVER THEIR DEFENCE. YOU WILL NOT SETTLE ANY SUCH CLAIMS WITHOUT OUR PRIOR WRITTEN CONSENT.
3.4. INJUNCTIVE RELIEF. YOU AGREE THAT ANY LOSS, DAMAGE OR HARM YOU SUFFER ARE NOT IRREPARABLE OR SUFFICIENT, AND OTHER REMEDIES WILL BE ADEQUATE, SUCH THAT YOU ARE NOT ENTITLED TO INJUNCTIVE OR OTHER EQUITABLE RELIEF AGAINST US.
4. Governing Law
This Agreement shall be governed by the law of the United States applicable therein. You hereby irrevocably attorn and submit to the non-exclusive jurisdiction of the courts of United States therefrom. If any provision shall be considered unlawful, void or otherwise unenforceable, then that provision shall be deemed severable from this License and not affect the validity and enforceability of any other provisions.
5. ONLINE USE
5.1. You must be at least 13 years old to use the Orbital Strike VR or Orbital Strike VR online services. If you are between 13 and 18, please ask your parent or guardian to supervise your use of the Orbital Strike VR.
5.2. By using Orbital Strike VR online services you agree to this Code of Conduct.
(a) Respect other players. Do not grief, harass, stalk, threaten or impersonate other players or people.
(b) Bad language. Do not use any foul or discriminatory language.
(c) Personal information. Do not share your personal information about yourself or other individuals (this includes name, phone numbers, email address, social media accounts).
(d) Play fair. Do not hack, cheat or otherwise give yourself an unfair advantage in our games.
(e) Draconis Interstellar LLC has a ZERO-tolerance for personal attacks, harassment, hate-speech against gender, sexual orientation, disability, appearance, body size, race, religion, or otherwise.
5.3. If we ban and/or suspend you due to a code of conduct violation, we will not have any obligations or liabilities to you at all.
5.4. Orbital Strike VR online services depends on third-party services that may go down from time to time and/or may be discontinued (specifically, online services requires Valve Steam Datagram Relay and Steam Lobby functionality). Draconis Interstellar LLC is not responsible for these services and online play may be disable or retired in the future.
5.5. We may patch, update or change Orbital Strike VR over time to add or remove game features. This may result in mandatory or automatic upgrades in order to continue playing offline and/or online.
6. CONSENT OF USE OF DATA
Draconis Interstellar LLC doesn't collect any of your personal data via the application. Outside of the application, Draconis Interstellar LLC may receive some personal data if given by the user.
(a) Email address: If you email customer support using your email address, we will hold this data so that we can help and respond to you.
7. Termination
Any failure to comply with the terms and conditions of this Agreement will result in automatic and immediate termination of this license. Upon termination of this license granted herein for any reason, you agree to immediately cease use of Orbital Strike VR and destroy all copies of Orbital Strike VR supplied under this Agreement.
