Einar - Loki's Traps END USER LICENSE AGREEMENT. [/]
In order to protect Einar - Loki's Traps [/] (our "Game") and members of our community, we need these end user license terms to establish some rules for downloading and using our Game. This license constitutes a legal agreement between you and us ( Monkey Indie Games - MIG [/]) and describes the terms and conditions of use of the Game. We don't like to read license documents in the same way that you don't, so we try to keep it as short and simple as possible for a good understanding. If you violate these rules, we can prevent you from using our Game.
Purchasing, downloading, using or playing our Game means that you agree to comply with the rules of these end user license agreement terms ("EULA"). If you do not want or cannot agree to these rules, you must not purchase, download, use or play our Game.
MAIN RULE [/]
The main rule is that you must not distribute anything that has been created by us, unless we specifically agree with that. "Distribute anything that has been created by us" means:
give copies of our Game to anyone else;
make commercial use of something that has been created by us;
try to make money from something that was created by us or
allowing others to gain access to anything that has been created by us in a way that is unfair or irrational;
unless we agree with that. And to be clear, "the Game" or "something created by us" includes, but is not limited to, the software of the server or client of our Game and includes Einar - Loki's Traps [/] S on all platforms . It also includes updates, fixes, downloaded content, add-ons or modified versions of a Game, part of those items or anything that has been created by us.
Otherwise, we are very condescending to what you do - in fact, we really encourage you to do cool things - but just don't do something that we instruct you not to do.
You can post game images, logo and others as long as you mention the game Einar - Loki's Traps [/] and link to the store.
USING OUR GAME [/]
You have been granted a license for the Game so that you can play and use it yourself on your device.
Below, we also grant you limited rights to do other things, but we have to limit in some way or people go over the limit. If you want to do something other than what has been done so far, we will be humble to accept it, but make sure that it cannot be interpreted as official and that the material complies with this EULA and the brand and asset usage guidelines, above all, do not make commercial use of anything that has been created by us.
The license and permission we grant you to use and play our Game may be revoked if you violate any of the terms of this EULA.
When you purchase our Game, you receive a license that grants you permission to install the Game on your own personal device and use and play it on that device, as defined in this EULA. This permission is specifically for you, so you are not allowed to distribute the Game (or any part of it) to anyone else. It also means that you cannot sell or rent the Game or make it available for access to others and you cannot transmit or resell any license key. However, you can give gift codes that have been purchased through an authorized supplier. This is important to help us prevent piracy and fraud and to protect our Game. It is also important to prevent members of our community from buying pirated versions of our Game or fraudulent license keys - which we and the reseller can cancel, as in the case of fraud.
Within reasonable limits, you are free to do whatever you like with screenshots and videos from the Game. By "within reasonable limits" we mean that you may not make any commercial use of them or do things that are unlawful or that adversely affect our rights, unless specifically permitted in this EULA, which we have permitted to do so through the Guidelines Use of the Brand and Assets or that you have a specific contract provided by us. If you upload videos from the game to video sharing and streaming sites, you are allowed to place ads on them. Also, don't cut art resources or pass them on, this is not funny.
Basically, the simple rule is not to make commercial use of anything that has been created by us, unless we have specifically agreed to it. If the law expressly permits this, as under the "fair use" or "fair dealing" doctrine, then we also agree - but only to the extent that the law applicable to you indicates such a circumstance.
To ensure the integrity of the Game, we will need all downloads and updates to the Game to come from an authorized source. It is also important for us that third party tools / services do not look "official" as we cannot guarantee their quality. This is part of the responsibility we have with CHILDREN VS ALIENS customers.
OWNERSHIP OF OUR GAME AND OTHER THINGS
Although we grant you permission to install on your device and play our Game, we are still the owners of it. We are also the owners of our brands and the content contained in the Game. Consequently, when you pay for our Game, you are purchasing a license to play / use our Game in accordance with this EULA - you are not purchasing the Game itself. The only permissions you have related to the Game and its installation are the permissions set out in this EULA.
CONTENT [/]
The logo Einar - Loki's Traps [/] like all the characters, scenarios, icons, items and images created inside or outside this game belongs to MONKEY INDIE GAMES [/].
You are only the owner of what you have created; you are not the owner of our code or content.
UPDATES [/]
We may make upgrades, updates or fixes available (we call them "updates") from time to time, but we don't have to do that. We are also not obligated to provide ongoing support or maintenance for any Game. Obviously, we hope to continue releasing new updates for our Game, we just cannot guarantee that we will do so. With updates comes changes that may not work well. This is unfortunate and very annoying, but we will try to resolve it as soon as possible, remembering that it is not fast and errors require time-consuming analyzes to better solve the problem.
You are free to report any errors you find through forums, e-mail, social networks and others, as long as it relates to our game or publisher.
RESPONSIBILITY AND APPLICABLE LAW [/]
The terms of this EULA do not affect any legal (statutory) rights you may have under the law that applies to you for the Game. You must have certain rights that the law applicable to you says cannot be excluded. Nothing we say in these terms will affect these legal rights, even though we know of something that appears to contradict your legal rights. That is what we mean when we say "subject to applicable law".
SUBJECT TO APPLICABLE LAW, WHEN YOU GET A COPY OF OUR GAME, WE PROVIDE IT "AS IS". UPDATES ARE ALSO PROVIDED "AS IS". THIS MEANS THAT WE ARE NOT MAKING ANY PROMISE TO YOU ABOUT THE STANDARD OR QUALITY OF OUR GAME OR THAT OUR CONTENT WILL BE UNINTERRUPTED OR WILL BE ERROR-FREE. WE ARE NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE THAT IT MAY CAUSE. YOU ASSUME THE ENTIRE RISK AS TO YOUR QUALITY AND PERFORMANCE. YOU HAVE TO ACCEPT THAT WE CAN LAUNCH GAMES WELL BEFORE THEY ARE COMPLETED AND THEREFORE THEY CAN (AND GENERALLY) HAVE BUGS - BUT WE PREFER TO LAUNCH THESE FEATURES BEFORE THAT MAKING YOU EXPECT PERFECTION. The laws of Brazil govern the interpretation of this EULA and require judicial or extrajudicial violations, regardless of conflicts of law principles. Your country's laws govern all other judicial or extrajudicial requirements and disputes (including consumer protection laws, unfair competition laws and non-contractual tort requirements and disputes related to our Game or our Site), regardless of the conflict of principles of laws.
TERMINATION [/]
If we choose, we can terminate this EULA if you violate any of the terms. You can also terminate it at any time; all you have to do is uninstall the Game from any device, and the EULA will be terminated. If the EULA is terminated, you will have no further rights in relation to the Game provided in this license. The paragraphs on "Ownership of Our Game", "Our Responsibility" and "General Provisions" will continue to apply even after the EULA is terminated.
USER DATA [/]
MONKEY INDIE GAMES does not collect or store your user data or any other information. With that we do not have to contact or have any access to you, except for the records and data that you have offered when purchasing the game for the dealer of our game. Where you authorized what data would be provided for contacts and control of playing time and achievements.
This data is not stored by MONKEY INDIE GAMES.
GENERAL PROVISIONS [/]
Your local law may provide you with rights that this EULA cannot change; if this occurs, this EULA will apply to the extent permitted by law. Nothing in this license limits our liability for death or personal injury resulting from our negligence or misrepresentation.
We may change this EULA from time to time if we have reason to do so, such as changes to our games, our practices or our legal obligation. But these changes will be effective only to the extent that they can be legally enforced. In that case, we will inform you of the change before it takes effect, by posting a notice on our Site or by other reasonable means.
