End User License Agreement (EULA)
1. Introduction
This End User License Agreement ("EULA") is a legal agreement between you ("User", "You", or "Your") and Divine Games, Inc ("Company", "We", "Us", or "Our") for the use of Demon Lord: Clicker ("Game" or "The Game"). By installing, accessing, or using the Game through the Steam platform, you agree to be bound by the terms of this EULA. If you do not agree to all of the terms of this EULA, you may not install, access, or use the Game.2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Game for your personal, non-commercial use, strictly in accordance with the terms of this EULA and Steam's Subscriber Agreement.3. Restrictions
When using the Game, you must use it in a manner that complies with the applicable laws in the jurisdiction(s) in which you use the Game.You agree not to, and you will not permit others to:
- Use any unauthorized third-party software, scripts, or any other means to cheat, exploit, or manipulate the Game in any way.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Game.
- Modify, alter, or create derivative works of the Game.
- Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Game or any copies of it.
- Remove, alter, or obscure any proprietary notices or labels on the Game.
4. Privacy Notices
The Game client automatically communicates with the Game server to provide secure gameplay functionality.The Game collects data about your Steam account for gameplay purposes. This data is required for basic functionality such as awarding items as Steam drops, player interactivity with the inventory, and creating Adventurer cards from the names of players across the playerbase.
If you do not want the possibility of a card with your Steam account name to be created, do not run the Game.
5. Cheating and Hacking
Cheating and hacking are strictly prohibited. This includes, but is not limited to:- Exploiting any in-game bugs, glitches, or vulnerabilities to gain an unfair advantage.
- Editing Game data in memory through any kind of hardware or software tool or utility.
- Sending any packet or message to the Game server that did not originate and send from the Game client.
- Engaging in any activity that disrupts the normal gameplay experience for others.
- Sharing or distributing any methods or tools related to cheating or hacking.
6. Banning
Divine Games reserves the right to restrict access to Demon Lord: Clicker through banning of any account at any time for any reason we deem appropriate.Exercising this right is primarily focused on attacks against our community through communication channels both in and outside the game, but can extend to any other unethical behavior.
7. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate immediately and automatically without any notice from the Company if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Game and destroy all copies of the Game in your possession or control.8. Updates and Modifications
We may update or modify the Game and this EULA at any time. Continued use of the Game after any such changes shall constitute your consent to such changes. If you do not agree to the changes, you must cease using the Game and uninstall it.9. Open-Source Notices
Certain components of the Game may be subject to open-source software licenses ("Open-Source Components"), which means any software license approved as open-source licenses by the Open Source Initiative or any substantially similar licenses, including without limitation any license that, as a condition of distribution of the software licensed under such license, requires that the distributor make the software available in source code format.To the extent there is conflict between the license terms covering the Open-Source Components and this EULA, the terms of such licenses will apply in lieu of the terms of this EULA. To the extent the terms of the licenses applicable to Open-Source Components prohibit any of the restrictions in this Agreement with respect to such Open-Source Component, such restrictions will not apply to such Open-Source Component. To the extent the terms of the licenses applicable to Open-Source Components require Licensor to make an offer to provide source code in connection with the Product, such offer is hereby made, and you may exercise it at .
10. Intellectual Property Notices
The Game and all worldwide copyrights, trade secrets, and other intellectual property rights therein are the exclusive property of Divine Games, Inc. The Company reserves all rights in and to the Game not expressly granted to you in this EULA.11. Disclaimer of Warranties
The Game is provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by applicable law, the Company disclaims all warranties, whether express, implied, or statutory, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.12. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to your use of or inability to use the Game.YOU EXPRESSLY UNDERSTAND AND AGREE THAT DIVINE GAMES INC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF DIVINE GAMES INC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RELATED TO THE GAME, including, for example: (i) the use or the inability to use the Game; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or items obtained (including "drops") or transactions entered into through or from the GAME; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third-party on the Game; (v) or any other matter relating to the Game.
Divine Games Inc reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Game, the Game Server, or any part thereof, with or without notice. The Company shall not be liable to you or to any third-party for any modification, update, suspension, or discontinuance of the Game.
