DEFINITIONS:
PRODUCT OR GAME here means Software, image files, sound files, all accompanying files, data, and materials received with your order of "HIGHLINE VOLLEYBALL VR".
CONTENT refers to content such as text, images, sounds, or other information that can be published on any media, websites, uploaded or stored on any computers or servers, linked to or otherwise made available by You, regardless of the form of that content.
COMPANY (referred to as either "The Company", "We", "Us" or "Our" in this Agreement) refers to PALLADIUM SUPER INTERACTIVE with office location registered in FRANCE: 3 place Verrazzano 69009 LYON.
If you do not agree to any of the terms of this License, then do not install, download, distribute or use the Product.
This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements, and arrangements. This Agreement shall be governed by the laws of FRANCE.
This PRODUCT and all services provided may be used for lawful purposes only.
ELIGIBILITY:
You are not allowed to use our Service and or Product if you are less than 13 years of age, or the laws of the jurisdiction in which you live prohibit use of our Services or Product.
If you are between the ages of 13 and 18 (or the age of majority where you live):
a. You and your parent or guardian must review this Agreement together before you use our Services and/or Product;
b. Your parent or guardian enters into this Agreement on your behalf and their own behalf when you use our Services and/or Product; and
c. Your parent or guardian will be responsible for all of your activities when you use our Services and/or Product.
LICENSE:
PALLADIUM SUPER INTERACTIVE grants You a revocable, non-exclusive, non-transferable, limited license to download, install and use this PRODUCT strictly in accordance with the terms of this Agreement.
This PRODUCT is for personal use only and shall not be used for any commercial purposes unless explicitly authorized with written consent by the Company. Its component parts may not be separated for use on more than one computer.
All components accompanying the software are copyrighted by PALLADIUM SUPER INTERACTIVE and may not be taken apart, modified, used, or published with other software or means except with the Product software and may not be distributed or copied in any manner.
PALLADIUM SUPER INTERACTIVE is the owner of the copyright of this PRODUCT, all its derivatives, title and accompanying materials are the exclusive property of PALLADIUM SUPER INTERACTIVE.
All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by PALLADIUM SUPER INTERACTIVE.
You may not rent, lease, transfer, host, share, modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on this PRODUCT.
You agree not to remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of the Company or its affiliates, partners, suppliers or the licensors of the PRODUCT.
You agree not to commercially exploit the PRODUCT or make the PRODUCT available to any third party.
WARRANTY:
This PRODUCT, all accompanying files, data and materials, are distributed "AS IS" and “AS AVAILABLE” and with all
faults and defects and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
In addition, in no event shall PALLADIUM SUPER INTERACTIVE, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of this PRODUCT.
The Company provides no warranty that the PRODUCT will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any
performance or reliability standards or be error free or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither the Company nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the PRODUCT, or the information, content, and materials or products included thereon; (ii) that the PRODUCT will be uninterrupted or error-free; (iii) as to the accuracy,
reliability, or currency of any information or content provided through the
PRODUCT; or (iv) that the PRODUCT, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts,
trojan horses, worms, malware, timebombs or other harmful components.
In addition, in no event does PALLADIUM SUPER INTERACTIVE authorize you to use this PRODUCT in applications or systems where PRODUCT's failure to perform can reasonably be expected to result in a physical injury, or in loss of life.
Any such use by you is entirely at your own risk, and you agree to hold PALLADIUM SUPER INTERACTIVE harmless from any claims or losses relating to such unauthorized use.

VIRTUAL REALITY USAGE:
To avoid injuries or property damages resulting from your game and or virtual reality usage please make sure to apply the following :
- ENSURE THAT YOU HAVE A GOOD HEALTH CONDITION TO BE ABLE TO PERFORM THE PHYSICAL EFFORTS NEEDED BY THE GAME
- TAKE A BREAK REGULARLY AND HYDRATE YOURSELF WHEN NEEDED
- MAKE SURE YOU HAVE ENOUGH FREE SPACE WITH NO OBSTACLES TO MOVE YOUR ARMS UP AND DOWN FREELY
- REMEMBER THAT YOU ARE IN A VIRTUAL ENVIRONMENT AND AVOID ANYTHING TO ENTER INTO YOUR PLAY SPACE (PEOPLE, ANIMALS etc...)
- DON'T DIVE OR JUMP FOR REAL, YOU CAN DO THESES ACTIONS BY PRESSING A CONTROLLER BUTTON
- DON'T RUN AND/OR GO BEYOND THE LIMIT OF YOUR PLAY ZONE, THIS GAME IS PROVIDING AUTOMATIC TELEPORTS AND FREE MOVE VIA CONTROLLER USAGE.
- CONFIGURE AND TURN ON YOUR HEADSET SAFE ZONE DISPLAY TO KNOW YOUR SPACE LIMIT WHILE PLAYING THE GAME
- ALWAYS TRY TO THINK THAT YOUR REAL ENVIRONMENT IS VERY DIFFERENT FROM THE VIRTUAL ENVIRONMENT.
Any use by you of the game is entirely at your own risk, and you agree to hold PALLADIUM SUPER INTERACTIVE, or its principals,
shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations,
harmless from any claims or losses relating to any injury, physical damages, loss of life.
PHOTOSENSITIVE WARNING:
A very small percentage of individuals may experience epileptic seizures when exposed to certain light patterns or flashing lights.
Exposure to certain patterns or backgrounds on a computer screen, or while playing video games, may induce an epileptic seizure in these individuals.
Certain conditions may induce previously undetected epileptic symptoms even in persons who have no history of prior seizures or epilepsy.
If you, or anyone in your family, have an epileptic condition, consult your physician prior to playing.
If you experience any of the following symptoms while playing a video or computer game -- dizziness, altered vision, eye or muscle twitches, loss of awareness,
disorientation, any involuntary movement, or convulsions -- IMMEDIATELY discontinue use and consult your physician before resuming play.
CONTENT:
You may not disclose to other persons the data or techniques relating to this PRODUCT that you know or should know that it is a trade secret of the PALLADIUM SUPER INTERACTIVE COMPANY in any manner that will cause damage to PALLADIUM SUPER INTERACTIVE.
Transmission, storage, or presentation of any information, data, or material in violation of any Country, State or City law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute.
You agree to indemnify and hold harmless PALLADIUM SUPER INTERACTIVE from any claims resulting from the use of this PRODUCT, which may damage any other party.
The Company is not responsible for the entries, information, or content of the PRODUCT users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using your account.
You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:
* Unlawful or promoting unlawful activity.
* Defamatory, discriminatory, or mean-spirited content, including references
or commentary about religion, race, sexual orientation, gender,
national/ethnic origin, or other targeted groups.
* Spam, machine – or - or randomly - – generated, constituting unauthorized
or unsolicited advertising, chain letters, any other form of unauthorized
solicitation, or any form of lottery or gambling.
* Containing or installing any viruses, worms, malware, trojan horses, or
other content that is designed or intended to disrupt, damage, or limit
the functioning of any software, hardware or telecommunications equipment
or to damage or obtain unauthorized access to any data or other
information of a third person.
* Infringing on any proprietary rights of any party, including patent,
trademark, trade secret, copyright, right of publicity or other rights.
* Impersonating any person or entity including the Company and its employees
or representatives.
* Violating the privacy of any third person.
* False information and features.
The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with this Agreement, refuse or remove any Content.
The Company further reserves the right to make formatting and edits and change the manner any Content. The Company can also limit or revoke the use of the PRODUCT if You post such objectionable Content.
As the Company cannot control all content posted by users and/or third parties on the PRODUCT, you agree to use the PRODUCT at your own risk. You understand that by using the PRODUCT You may be exposed to content that
You may find offensive, indecent, incorrect or objectionable, and You agree that under no circumstances will the Company be liable in any way for any content, including any errors or omissions in any content, or any loss or
damage of any kind incurred as a result of your use of any content.
SEVERABILITY AND WAIVER:
SEVERABILITY
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
WAIVER
Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not effect a party's ability to exercise such right or require such performance at any time
thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.
CODE OF CONDUCT:
Palladium Super Interactive supports a friendly, respectful community for the Game.
Where we make the functionality available, certain aspects of the Game may include multiplayer, messaging other users, voice chat and other multiplayer and community functionalities. All users must act reasonably and fairly when interacting with other Game users. All hacking, cheating, bug exploitation, misuse of the Game, trolling, deceptive or abuse conduct is prohibited.
Please act responsibly and in a way which respects the rights of other users.
You must not abuse other users, harass them or engage in trolling or stalking behaviour.
You must not take any action, upload or share any content, or otherwise use the Game in any way which is in any way immoral, unethical, hateful, offensive, a breach of privacy, illegal, racist, vulgar, pornographic, sexually offensive, libellous, defamatory, threatening and/or bullying.
You must not cause disruption to the Game or in any way interfere with the proper operation of the Game, including without limitation by damaging any account, software, hardware or network.
You must not upload spam, commercial, marketing, advertisement or solicitation content or promotional content or any third party links.
You must not impersonate any person, including without limitation Palladium Super Interactive staff.
You are not permitted to sell or buy in-Game virtual items with other Game users or third parties for real-world currency (except for authorised transactions, where applicable, from Palladium Super Interactive, the Stores and our other third party partners).
You are not permitted to buy or sell, where applicable, accounts to access the Game or in connection with the Game.
Please respect the intellectual property rights of third parties.
You must not post, upload, release, distribute or in any other way make available on or through the Game any content or materials which include, use or contain (in whole or in part) any intellectual property rights of any third party (including without limitation copyright, trade marks and any other intellectual property).
We are not responsible for moderating, monitoring or recording any activity in the Game or in connection with the Game (including without limitation messages, posts, written chat and voice chat between players), although we reserve the right to do so. We may (but we are not obliged to) moderate such content and activities to ensure they are in compliance with the terms of this EULA. We reserve the right to delete, without notice, any content, materials and/or communications which are in breach of this EULA. In serious cases, we may take steps together with the Stores or relevant platforms for the Game (such as Xbox, PlayStation and Steam) and/or with law enforcement authorities and this may involve us disclosing information to those third parties and authorities.
In the event of a breach of the EULA, Palladium Super Interactive reserves the right to immediately terminate this EULA and your use of the Game without you being entitled to any refund or compensation.
PRIVACY:
Under data protection legislation, we are required to provide you with certain additional informations on how we process your personal data and for what purposes.
We are also required to provide you with information about your rights in relation to your personal data and how to exercise them.
* Purpose of data collection
We do not sell or store directly any personal informations.
We only collect the data needed to operate game functionalities as for example : online multiplayer, leaderboards, chat and voicechat.
These data are limited to what is made available to us by Steam, Playstation, XBox, Playfab, through the use of their services.
Steam name and associated scores or achievements may also be published outside of Steam.
The game generates diagnostic logs related to its systems that can be usefull for support when a failure occurs.
A data collection of hardware informations and operating system crash dump is also generated upon application failure or crash.
There is no automatic transmission of theses diagnostics data, they stay stored on your computer product installation folder, and it maybe required by the Company for any support request from you.
You agree to provide these elements when necessary otherwise any support request will not be valid and considered closed.
* Data collection information
The data is collected during gameplay, transferred and stored in a cloud via network hosting third parties such as Microsoft Azure Playfab or Epic Online Services, and stores such as Steam, Playstation or XBox (depending on the platform you run the game).
Some of theses data like the username can be shared with other players for the purpose of gameplay.
* Data collected and stored into third parties systems
Platform identifiers and store user account for the purpose of authentification with the service providers (Steam/Playstation/XBox)
IP address for the purpose of data transfers between the players
Friends lists for the purpose of multiplayer gameplay
Lobby informations for the purpose of multiplayer gameplay
Game statistics such as achievements and leaderboards for the purpose of gameplay
Service provider usage and monitoring statistics (Microsoft Azure Playfab, Steam, Playstation, Xbox)
* Data collected and transmitted to other players
The data that are collected and transmitted to other players but not stored are the following :
A set of game states needed to operate the multiplayer gameplay
Usernames
Lobby informations
* Data disclosure
Third parties and Palladium Super Interactive can disclose theses informations if required by the law or jurisdictions.
* Data deletion
In case of a request, you acknowledge that such a deletion will be permanent and irreversible and all gameplay informations such as leaderboard ranking will be definitely lost.
You can request a deletion of your personal data by sending us your claim with your user account identifier by email to privacy at palladiumsuperinteractive dot com or through our website contact form by specifying as the subject Data Deletion Request.
By accepting this Agreement, You acknowledge that You hereby agree and consent to the terms and conditions of Our Privacy Policy.
INTELLECTUAL PROPERTY:
The PRODUCT, including without limitation all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of the Company.
The Company shall not be obligated to indemnify or defend You with respect to any third party claim arising out of or relating to the Application.
To the extend the Company is required to provide indemnification by applicable law, the Company shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Application or your use of it infringes any third party intellectual property rights.
PRODUCT UPDATES:
The Company reserves the right to modify, suspend or discontinue, temporarily
or permanently, the PRODUCT or any service to which it connects, with or without notice and without liability to You.
The Company may from time to time provide enhancements or improvements to the
features/functionality of the Application, which may include bug fixes, updates, upgrades and other modifications.
Updates may modify or delete certain features and/or functionalities of the
PRODUCT. You agree that the Company has no obligation to (i) provide any
Updates, or (ii) continue to provide or enable any particular features and/or
functionalities of the Application to You.
You further agree that all updates or any other modifications will be (i)
deemed to constitute an integral part of the Application, and (ii) subject to
the terms and conditions of this Agreement.
BETA TESTS/PLAY TESTING:
We may in our own discretion, permit You to test, evaluate or comment on one or more Services before they are marketed or launched, in order to identify bugs and errors in the programs and/or improve their functioning ("Beta Test"). You agree that the Beta Test content which is supplied to You under a Beta Test is highly confidential information belonging to us and that you shall not disclose or use such confidential information, unless authorized in writing by Palladium Super Interactive.
You may be required to sign a confidentiality or other agreement for each Beta Test in which You participate.
You must perform the Beta Test personally.
All comments, feedback, suggestions, ideas, criticisms and other data (collectively referred to as the "Comments") passed on, disclosed or offered to us in the course of the Beta Tests shall constitute the confidential information of Palladium Super Interactive and will be the exclusive property of Palladium Super Interactive.
You therefore agree not to make your Comments accessible by any means or process to any outside party other than Palladium Super Interactive.
You acknowledge that, unless prohibited from doing so under applicable law, We may use, sell, promote and exploit the Comments in any way, without restriction and without compensation to You. You acknowledge that We may protect certain Beta Test content by incorporating technical protection measures in them to prevent any unlawful reproduction or modification of such content. Beta Test content is supplied to You "as is" and "according to availability" without any explicit or implicit guarantee of any kind. You use a beta version at your own risk. You accept that (i) the Beta Test version may include known or unknown bugs; and (ii) your progress and your data in the game may be erased at any time. At the end of the test period, or at any time when We ask You to do so, You shall return immediately all content received from us.
You agree that violation of your obligations under this Section would cause us irreparable damage and that We would be entitled to take any action to prevent any breach or risk of a breach of your obligations or to obtain compensation for the damage We have incurred, in addition and without prejudice to the right to terminate your Account in accordance with these Terms.
Nothing in these Terms may be interpreted as giving You any right or privilege regarding the Beta Test content.
If you have been elected to own a free closed beta license, it is uniquely assigned to you.
The licence validity can be revoked at any time and for any reason or no reason by Palladium Super Interactive.
GOVERNING LAW AND JURISDICTION:
This Agreement shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions.
The parties shall submit to the exclusive jurisdiction of the French Courts. The parties waive any other venue to which either party might be entitled by domicile or otherwise.
THIRD PARTY SERVICES AND MIDDLEWARES:
The Application may display, include or make available third-party content
(including data, information, applications and other products services) or
provide links to third-party websites or services.
You acknowledge and agree that the Company shall not be responsible for any
Third-party Services, including their accuracy, completeness, timeliness,
validity, copyright compliance, legality, decency, quality or any other aspect
thereof. The Company does not assume and shall not have any liability or
responsibility to You or any other person or entity for any Third-party
Services.
You must comply with applicable Third parties' Terms of agreement when using
the PRODUCT. Third-party Services and links thereto are provided solely as
a convenience to You and You access and use them entirely at your own risk and
subject to such third parties' Terms and conditions.

Any use by you of the game is entirely at your own risk, and you agree to hold PALLADIUM SUPER INTERACTIVE, or its principals,
shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations,
harmless from any claims or losses relating to any injury, physical damages, loss of life.
PHOTOSENSITIVE WARNING:
A very small percentage of individuals may experience epileptic seizures when exposed to certain light patterns or flashing lights.
Exposure to certain patterns or backgrounds on a computer screen, or while playing video games, may induce an epileptic seizure in these individuals.
Certain conditions may induce previously undetected epileptic symptoms even in persons who have no history of prior seizures or epilepsy.
If you, or anyone in your family, have an epileptic condition, consult your physician prior to playing.

CONTENT:
You may not disclose to other persons the data or techniques relating to this PRODUCT that you know or should know that it is a trade secret of the PALLADIUM SUPER INTERACTIVE COMPANY in any manner that will cause damage to PALLADIUM SUPER INTERACTIVE.
Transmission, storage, or presentation of any information, data, or material in violation of any Country, State or City law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute.
You agree to indemnify and hold harmless PALLADIUM SUPER INTERACTIVE from any claims resulting from the use of this PRODUCT, which may damage any other party.
The Company is not responsible for the entries, information, or content of the PRODUCT users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using your account.
You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:
* Unlawful or promoting unlawful activity.
* Defamatory, discriminatory, or mean-spirited content, including references
or commentary about religion, race, sexual orientation, gender,
national/ethnic origin, or other targeted groups.
* Spam, machine – or - or randomly - – generated, constituting unauthorized
or unsolicited advertising, chain letters, any other form of unauthorized
solicitation, or any form of lottery or gambling.
* Containing or installing any viruses, worms, malware, trojan horses, or
other content that is designed or intended to disrupt, damage, or limit
the functioning of any software, hardware or telecommunications equipment
or to damage or obtain unauthorized access to any data or other
information of a third person.
* Infringing on any proprietary rights of any party, including patent,
trademark, trade secret, copyright, right of publicity or other rights.
* Impersonating any person or entity including the Company and its employees
or representatives.
* Violating the privacy of any third person.
* False information and features.
The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with this Agreement, refuse or remove any Content.
The Company further reserves the right to make formatting and edits and change the manner any Content. The Company can also limit or revoke the use of the PRODUCT if You post such objectionable Content.
As the Company cannot control all content posted by users and/or third parties on the PRODUCT, you agree to use the PRODUCT at your own risk. You understand that by using the PRODUCT You may be exposed to content that
You may find offensive, indecent, incorrect or objectionable, and You agree that under no circumstances will the Company be liable in any way for any content, including any errors or omissions in any content, or any loss or
damage of any kind incurred as a result of your use of any content.
SEVERABILITY AND WAIVER:
SEVERABILITY
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
WAIVER
Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not effect a party's ability to exercise such right or require such performance at any time
thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.
CODE OF CONDUCT:
Palladium Super Interactive supports a friendly, respectful community for the Game.
Where we make the functionality available, certain aspects of the Game may include multiplayer, messaging other users, voice chat and other multiplayer and community functionalities. All users must act reasonably and fairly when interacting with other Game users. All hacking, cheating, bug exploitation, misuse of the Game, trolling, deceptive or abuse conduct is prohibited.
Please act responsibly and in a way which respects the rights of other users.
You must not abuse other users, harass them or engage in trolling or stalking behaviour.
You must not take any action, upload or share any content, or otherwise use the Game in any way which is in any way immoral, unethical, hateful, offensive, a breach of privacy, illegal, racist, vulgar, pornographic, sexually offensive, libellous, defamatory, threatening and/or bullying.
You must not cause disruption to the Game or in any way interfere with the proper operation of the Game, including without limitation by damaging any account, software, hardware or network.
You must not upload spam, commercial, marketing, advertisement or solicitation content or promotional content or any third party links.
You must not impersonate any person, including without limitation Palladium Super Interactive staff.
You are not permitted to sell or buy in-Game virtual items with other Game users or third parties for real-world currency (except for authorised transactions, where applicable, from Palladium Super Interactive, the Stores and our other third party partners).
You are not permitted to buy or sell, where applicable, accounts to access the Game or in connection with the Game.
Please respect the intellectual property rights of third parties.
You must not post, upload, release, distribute or in any other way make available on or through the Game any content or materials which include, use or contain (in whole or in part) any intellectual property rights of any third party (including without limitation copyright, trade marks and any other intellectual property).
We are not responsible for moderating, monitoring or recording any activity in the Game or in connection with the Game (including without limitation messages, posts, written chat and voice chat between players), although we reserve the right to do so. We may (but we are not obliged to) moderate such content and activities to ensure they are in compliance with the terms of this EULA. We reserve the right to delete, without notice, any content, materials and/or communications which are in breach of this EULA. In serious cases, we may take steps together with the Stores or relevant platforms for the Game (such as Xbox, PlayStation and Steam) and/or with law enforcement authorities and this may involve us disclosing information to those third parties and authorities.
In the event of a breach of the EULA, Palladium Super Interactive reserves the right to immediately terminate this EULA and your use of the Game without you being entitled to any refund or compensation.
PRIVACY:
Under data protection legislation, we are required to provide you with certain additional informations on how we process your personal data and for what purposes.
We are also required to provide you with information about your rights in relation to your personal data and how to exercise them.
* Purpose of data collection
We do not sell or store directly any personal informations.
We only collect the data needed to operate game functionalities as for example : online multiplayer, leaderboards, chat and voicechat.
These data are limited to what is made available to us by Steam, Playstation, XBox, Playfab, through the use of their services.
Steam name and associated scores or achievements may also be published outside of Steam.
The game generates diagnostic logs related to its systems that can be usefull for support when a failure occurs.
A data collection of hardware informations and operating system crash dump is also generated upon application failure or crash.
There is no automatic transmission of theses diagnostics data, they stay stored on your computer product installation folder, and it maybe required by the Company for any support request from you.
You agree to provide these elements when necessary otherwise any support request will not be valid and considered closed.

The data is collected during gameplay, transferred and stored in a cloud via network hosting third parties such as Microsoft Azure Playfab or Epic Online Services, and stores such as Steam, Playstation or XBox (depending on the platform you run the game).
Some of theses data like the username can be shared with other players for the purpose of gameplay.

Platform identifiers and store user account for the purpose of authentification with the service providers (Steam/Playstation/XBox)
IP address for the purpose of data transfers between the players
Friends lists for the purpose of multiplayer gameplay
Lobby informations for the purpose of multiplayer gameplay
Game statistics such as achievements and leaderboards for the purpose of gameplay
Service provider usage and monitoring statistics (Microsoft Azure Playfab, Steam, Playstation, Xbox)
* Data collected and transmitted to other players
The data that are collected and transmitted to other players but not stored are the following :
A set of game states needed to operate the multiplayer gameplay
Usernames
Lobby informations
* Data disclosure
Third parties and Palladium Super Interactive can disclose theses informations if required by the law or jurisdictions.
* Data deletion
In case of a request, you acknowledge that such a deletion will be permanent and irreversible and all gameplay informations such as leaderboard ranking will be definitely lost.
You can request a deletion of your personal data by sending us your claim with your user account identifier by email to privacy at palladiumsuperinteractive dot com or through our website contact form by specifying as the subject Data Deletion Request.
By accepting this Agreement, You acknowledge that You hereby agree and consent to the terms and conditions of Our Privacy Policy.
INTELLECTUAL PROPERTY:
The PRODUCT, including without limitation all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of the Company.
The Company shall not be obligated to indemnify or defend You with respect to any third party claim arising out of or relating to the Application.
To the extend the Company is required to provide indemnification by applicable law, the Company shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Application or your use of it infringes any third party intellectual property rights.
PRODUCT UPDATES:
The Company reserves the right to modify, suspend or discontinue, temporarily
or permanently, the PRODUCT or any service to which it connects, with or without notice and without liability to You.
The Company may from time to time provide enhancements or improvements to the
features/functionality of the Application, which may include bug fixes, updates, upgrades and other modifications.
Updates may modify or delete certain features and/or functionalities of the
PRODUCT. You agree that the Company has no obligation to (i) provide any
Updates, or (ii) continue to provide or enable any particular features and/or
functionalities of the Application to You.
You further agree that all updates or any other modifications will be (i)
deemed to constitute an integral part of the Application, and (ii) subject to
the terms and conditions of this Agreement.
BETA TESTS/PLAY TESTING:
We may in our own discretion, permit You to test, evaluate or comment on one or more Services before they are marketed or launched, in order to identify bugs and errors in the programs and/or improve their functioning ("Beta Test"). You agree that the Beta Test content which is supplied to You under a Beta Test is highly confidential information belonging to us and that you shall not disclose or use such confidential information, unless authorized in writing by Palladium Super Interactive.
You may be required to sign a confidentiality or other agreement for each Beta Test in which You participate.
You must perform the Beta Test personally.
All comments, feedback, suggestions, ideas, criticisms and other data (collectively referred to as the "Comments") passed on, disclosed or offered to us in the course of the Beta Tests shall constitute the confidential information of Palladium Super Interactive and will be the exclusive property of Palladium Super Interactive.
You therefore agree not to make your Comments accessible by any means or process to any outside party other than Palladium Super Interactive.
You acknowledge that, unless prohibited from doing so under applicable law, We may use, sell, promote and exploit the Comments in any way, without restriction and without compensation to You. You acknowledge that We may protect certain Beta Test content by incorporating technical protection measures in them to prevent any unlawful reproduction or modification of such content. Beta Test content is supplied to You "as is" and "according to availability" without any explicit or implicit guarantee of any kind. You use a beta version at your own risk. You accept that (i) the Beta Test version may include known or unknown bugs; and (ii) your progress and your data in the game may be erased at any time. At the end of the test period, or at any time when We ask You to do so, You shall return immediately all content received from us.
You agree that violation of your obligations under this Section would cause us irreparable damage and that We would be entitled to take any action to prevent any breach or risk of a breach of your obligations or to obtain compensation for the damage We have incurred, in addition and without prejudice to the right to terminate your Account in accordance with these Terms.
Nothing in these Terms may be interpreted as giving You any right or privilege regarding the Beta Test content.
If you have been elected to own a free closed beta license, it is uniquely assigned to you.
The licence validity can be revoked at any time and for any reason or no reason by Palladium Super Interactive.
GOVERNING LAW AND JURISDICTION:
This Agreement shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions.
The parties shall submit to the exclusive jurisdiction of the French Courts. The parties waive any other venue to which either party might be entitled by domicile or otherwise.
THIRD PARTY SERVICES AND MIDDLEWARES:
The Application may display, include or make available third-party content
(including data, information, applications and other products services) or
provide links to third-party websites or services.
You acknowledge and agree that the Company shall not be responsible for any
Third-party Services, including their accuracy, completeness, timeliness,
validity, copyright compliance, legality, decency, quality or any other aspect
thereof. The Company does not assume and shall not have any liability or
responsibility to You or any other person or entity for any Third-party
Services.
You must comply with applicable Third parties' Terms of agreement when using
the PRODUCT. Third-party Services and links thereto are provided solely as
a convenience to You and You access and use them entirely at your own risk and
subject to such third parties' Terms and conditions.
