The ”Operation: Forge the Deep” game (hereinafter “Game” or “We”) aims to study, analyze, understand, predict, and design human-based computation models and to optimize human-computer interactions and systems. We achieve this through observing the interactive behavior of end users and their gameplay responses. The Game continuously gathers and analyzes end user data. By creating an account, playing the Game, and/or using the website or associated communication channels, You acknowledge and agree that:
We are recording gameplay data for analysis and research. The Game gathers and records data generated by Your activities in the Game. If You create an account, this data will be associated with Your account. If You play without an account or offline, data will be gathered anonymously by assigning You an anonymous identifier. Data may be associated with Your IP address. Gameplay data such as scores, algorithms, tool and algorithm usage, progress, and time played may be logged and analyzed.
We also may record interactions with our website, chat, and/or other communication channels, many of which are public. Note, however, that most interactions will be within the context of a real-time forum and the Steam Community page, subject to Steam’s privacy policy and notice. Nevertheless, please be aware that since areas of our chat and website are publicly available, We are unable to prevent third parties from independently logging these channels. In addition, We may collect and use technical information, including but not limited to information about Your computer, system software, other software and peripherals, that is gathered periodically to facilitate the provision of software updates and other services (if any) to You related to the Game, and to verify compliance with the terms of this Agreement.
We collect, analyze, and use aggregated, de-identified technical data and related information (such as Game usage, device metrics and/or metadata) to facilitate the computational research mentioned above, software development and improvement, and to provide support and maintenance services. The derivation of aggregate information, data, assumptions, conclusions, gameplay history, and information regarding player interaction with the Game help create computational profiles reflecting human preferences, cognitive pathways, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, strategies, abilities, and aptitudes. We may use, store, or disclose such aggregated and analyzed information, or material derived from such information, as long as it is in a form that does not identify or is not attributable to You or any individual.
Aggregated and de-identified data may be used for research and made public or shared with collaborators. De-identified data and analysis may be shown in the Game, on the website, and used in external publications, presentations, promotional materials, and other public venues. Data logged by the Game may be shared with domain experts for analysis. We will contact You for permission before externally associating data analysis with Your specific name. Your account name, however, may appear without explicit permission in external demonstrations of the Game or website, including presentations, videos, screenshots, and publications.
To avoid potential misunderstandings, with the exception of safeguarding end user passwords, We cannot agree to, and expressly disclaim, any confidentiality obligations or use restrictions, express or implied, with respect to any information that You provide in connection with the creation of an account name, unique pseudonyms, user alias(es), or other similar identifiers, including other forms of persistent or probabilistic identifiers (i.e., the identification of a person or a device to a degree of certainty of more probable than not) that can be used to identify a particular person or device, and other metadata (collectively, “End User Disclosures”). You agree that any End User Disclosures will be non-confidential. You release us from all liability and obligations that may arise from the receipt, review, use, or disclosure of any portion of any End User Disclosures.
Nevertheless and notwithstanding the foregoing, We will implement appropriate security measures (including but not limited to network firewalls, and encrypted authentication certificate technologies, back-up systems, and collocated Servers) to protect Game content and end user data. We will limit access to and use of any confidential or personal end user information only to our employees, agents, and/or contractors who have a need to know and only for use in connection with use of the Game. We shall otherwise safeguard any confidential or personal information received using a reasonable degree of care, but not less than the degree of care used in safeguarding our own similar information or material.
We cooperate with government and law enforcement officials to enforce and comply with the law. We will disclose any information about end users upon a valid request by government or law officials as We, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including, without limitation, subpoenas), to protect Your property and rights, or the property and rights of a third party, to protect the safety of the public or any person, or to stop activity that We consider illegal or unethical.
We may occasionally post notices, comments, responses, screenshots, and research surveys on our website, chat, and/or other communication channels. The surveys will ask basic questions about topics such as motivation or demographic information, such as age, gender, and education level. PARTICIPATION IN THESE SURVEYS IS ENTIRELY VOLUNTARY. Further, we encourage end users to post or report bugs, fixes, wish lists, requested features, comments, community suggestions and help, etc., (collectively, “Reports”). You acknowledge and agree that You will not be remunerated for any Reports posted and that We will have no obligation to follow up on or implement any Reports.
Your use of and participation in the Game will not create any personal right, ownership, title, or interest in or to the Game. Any intellectual property derived from and/or good will associated with the Game and/or Reports will inure to our benefit. You acknowledge that any and all Reports, contributions, participation, and/or crowdsource development contributed by You will be subject to this paragraph. You further agree not to exploit any services provided hereunder in any unlawful or unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity. We may terminate, suspend, or block Your account at any time.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE GAME IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU.
