Terms of Service
CipSoft GmbH, Prüfeninger Straße 20, 93049 Regensburg, Germany (“CipSoft”) operates the game Persist Online (“Game”). This service agreement (“Agreement”) defines the terms and conditions on which CipSoft offers you access to the Game.§ 1 Subject of the Contract
(1) CipSoft grants you access to the Game free of charge. It is your responsibilty to check the system requirements and to ensure that your connection to the internet is working.
(2) CipSoft grants you the non-exclusive, non-transferable, limited right to use the Game for your personal non-commercial use for gameplay on any device that you own or control. You acknowledge that no title or ownership in the Game is being transferred or assigned. This Agreement does not constitute a sale of any rights in the Game. All rights not specifically granted under this Agreement are reserved by CipSoft.
(3) CipSoft reserves the right to develop the Game further, even if this incurs changes to the rules of the Game.
§ 2 Termination
(1) You may terminate this Agreement, without cause and for no reason, at any time by not accessing it any longer.
(2) CipSoft may exclude you from the Game if you violate the terms and conditions of this contract.
(3) CipSoft reserves the right to permanently shut down the Game thus terminating this Agreement at any time.
§ 3 Limitation of Warranty and Liability
(1) CipSoft does not guarantee continuous or error-free operation of the Game. CipSoft provides the Game “as is” and disclaims all warranties or conditions of any kind, expressed, implied or statutory, including, without limitation, the implied warranties of title, non-infringement, merchantability and fitness for a particular purpose. CipSoft reserves the right to temporarily shut down the Game at any time for maintainance reasons.
(2) CipSoft cannot be held liable for loss of profit or any other special, incidental or consequential damages arising out of or in connection to the Game, unless said damages were caused by intentional or gross negligence on their part.
§ 4 Final Provisions
(1) CipSoft reserves the right to modify the terms and conditions of this Agreement at any time. The modification will be deemed accepted if you continue to access the Game.
(2) In the event that one or more provisions of this Agreement should be or become invalid, the validity of the remaining provisions shall not be affected thereby. The invalid provisions shall be deemed to be replaced with such legally permissible provisions which come as close as possible to the purpose of the invalid provisions.
(3) This Agreement shall be governed by the laws of the Federal Republic of Germany, excluding any conflict of laws rules. Exclusive place of jurisdiction for all disputes arising out of or in connection with this Agreement shall be Regensburg, Germany.
Privacy Policy
CipSoft GmbH, Prüfeninger Straße 20, 93049 Regensburg, Germany (“CipSoft”) operates the game Persist Online (“Game”). This Privacy Policy explains in detail what data is collected and for which purposes it will be processed and used.Collected Data and Their Purpose
CipSoft collects, processes and uses personal data (e.g. your IP address) that is necessary to perform the service. In addition CipSoft receives statistical information on the number of users, the time spent within the game, and demographic data. CipSoft uses this information for error analysis and optimization of the Game.
When you access the website of the Game, no personal data will be collected by CipSoft. CipSoft only stores partial IP addresses for statistical purposes. For IP addresses of type v4, the last byte of the 4-byte address will be removed. For IP addresses of type v6, the last 8 bytes of the 16-byte address will be removed. Our website uses cookies to store your preferences, no tracking happens by the use of cookies. Embedded third party functionality uses cookies that are stored on their website.
Conversion tracking helps us to measure the effectiveness of advertisements for statistical and market research purposes. The data collected in this way is anonymous to us; we do not see the personal data of individual users. However, this data is stored and processed by our advertisement partner. Our Conversion tracking solution is free of cookies.
We embed YouTube videos in our website. The embedded videos will be tracked by YouTube with the help of cookies. You can disable the YouTube tracking by disallowing “Embedded YouTube cookies” in the cookie settings.
We use Cloudflare to make our website faster and safer. Cloudflare uses cookies and processes user data. The usage of cloudflare is essential and therefore the cookie cannot be disabled in the cookie settings. The cookie is named: _cfduid.
The cookie and conversion tracking settings will be stored in cookies. The preferences cookies are essential and cannot be disabled in the cookie settings. The preferences cookies will be stored for 90 days. The cookies are named: consent.
When you use the client software, no personal data will be stored and collected by CipSoft. The client software will access the website of the Game to check for updates of the Game, to calculate the miner fee, faster download of the blockchain and integrity checks of the state of the Game, but no personal data will be collected in that cases (see above). These accesses can be deactivated in the Game software. The Game software will also access the Litecoin network to read and write transactions, thus revealing your IP address to third parties. CipSoft has no control about what personal data is collected and stored by the operators of Litecoin network nodes.
When you contact CipSoft's customer support team, CipSoft will collect, process and use personal data in order to comply with such requests in as efficient and satisfactory a manner as possible. Data that is collected for such purposes includes, but is not limited to, the email address, the date of the contact and its content. Also, CipSoft processes and uses this data to compile anonymous statistical surveys for the optimization of their customer support.
Newsletter
We use the Google service reCaptcha to determine whether a person or a computer makes a specific entry in our contact or newsletter form. Google uses the following information to determine if you are a human being or a computer: IP address of the terminal device you are using, the website you are visiting and on which the captcha is integrated, the date and duration of the visit, the identification data of the browser and operating system type used, Google account if you are logged in to Google, mouse movements on the reCaptcha areas and tasks for which you must identify images. The legal basis for the described data processing is Art. 6 para. 1 lit. f GDPR. There is a legitimate interest on our part in this data processing to ensure the security of our website and to protect us from automated input (attacks). Newsletters will be managed by the third party company CleverReach. By subscribing to our newsletter, you agree that your email address and IP address will be stored at their servers.
Conversion Tracking
Conversion tracking helps us to measure the effectiveness of advertisements for statistical and market research purposes. We include a tracking pixel on the website that helps to track that you have clicked on an advertisement of our partner and have been redirected to our website. A cookie may also be stored on your computer for these purposes. The data collected in this way is anonymous to us; we do not see the personal data of individual users. However, this data is stored and processed by our advertisement partner.

Disclosure to Third Parties
CipSoft will pass on personal data, to the extent that is necessary, to law enforcement and supervisory authorities for the purpose of preventing dangers to the national or public security as well as for the prosecution of criminal offences.
CipSoft will pass on the name, address and, to the extent that is necessary in individual cases, further personal data of users to its partner companies to provide services in the framework of the users’ service agreement with CipSoft.
Third parties may possibly be based in countries outside of the European Union, but they are bound to protect personal data to the same extent as CipSoft. CipSoft will not, aside from the aforementioned cases, pass on personal data to third parties, and only employees of CipSoft have access to personal data in order to fulfil the tasks specified above.
Your Rights as Data Subject
You can change, give or revoke consent regarding cookies on the Persist Online website.
You have the right of access to the personal data being processed by CipSoft (Art. 15 GDPR) as well as the right to rectify (Art. 16 GDPR) or erase (Art. 17 GDPR) these personal data. Furthermore, you have the right to restriction of processing (Art. 18 GDPR), the right to object to processing of personal data (Art. 21 GDPR) and the right to data portability (Art. 20 GDPR). These rights might be restricted due to the used distributed ledger technology. Please send an email to [email protected], if you want to exercise these rights. If you revoke your declaration of consent to the processing of your personal data, you can no longer use CipSoft's personalized services.
