THUNDERFUL Game End-User License Agreement
PLEASE READ THIS END-USER LICENSE AGREEMENT CAREFULLY. IF YOU DO NOT AGREE TO ALL THE TERMS IN THIS END-USER LICENSE AGREEMENT, YOU ARE NOT PERMITTED TO OPEN, DOWNLOAD, INSTALL, COPY OR USE THE GAME.
STEAMWORLD BUILD END-USER LICENSE AGREEMENT
In order to protect STEAMWORLD BUILD (the “Game”), the terms of this end-user li-cense agreement (the “EULA”) apply when you download and use the Game. This EULA constitutes a legal agreement between you and Thunderful Group AB (“we”, “us” and/or “Thunderful”). Any breach of this EULA may result in us stopping you from using the Game and, if we deem it necessary, take any and all types of legal action.
By downloading, installing, or using this Game, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not download, install or use the Game.
Please read through the foregoing documents carefully before downloading or using the Game, since by agreeing to this EULA, you also agree to all of the terms of the foregoing documents.
USING THE GAME
Subject to the terms of this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Game solely for your personal, non-commercial use.
As a user of the Game, you may not in any way:
a) copy, modify, distribute, sell, or transfer the Game or any portion thereof,
b) violate, or attempt to violate, the security or integrity of the Game or any other network, electronic service, computer, application or other technical equipment and software,
c) reverse engineer, decompile, or disassemble the Game or any portion thereof,
d) remove any proprietary notices or labels on the Game or any portion thereof,
e) allow any third-party to use the Game on behalf of or for the benefit of any third-party,
f) use the Game for any commercial purpose,
g) use the Game in any way that violates any applicable law or regulation; or
h) use the Game to infringe upon any intellectual property rights of any third party.
OWNERSHIP
The Game, including all intellectual property rights therein, is owned by us and our licen-sors. The Game is licensed, not sold, to you. You hereby acknowledge that no title or own-ership of the Game is being transferred or assigned, and this EULA does not represent a sale of any individual rights in the Game to you. We retain all right, title and interest to the Game, including, but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, patents, titles, computer codes, audiovisual effects, themes, characters, character names, stories, dialog, settings, artwork, sound effects, musical works, and mor-al rights.
USER CONTENT
You may create content in relation to the Game, including but not limited to, a gameplay map, scenario, screenshot, design, item, or video of your gameplay. In exchange for use of the Game, and to the extent that your contributions through use of the Game give rise to any copyright interest, you hereby grant us an exclusive, perpetual, irrevocable, fully transferrable, and sub-licensable worldwide right and license to use your contributions in any way and for any purpose in connection with the Game and related goods and services, including, but not limited to, the rights to reproduce, copy, adapt, modify, perform, dis-play, publish, broadcast, transmit, and otherwise communicate to the public by any means available, and distribute your contributions without any further notice or compensation to you of any kind. You hereby waive and agree never to assert any rights or claims with re-spect to our, and other players’ use and enjoyment of such contributions in connection with the Game and related goods and services. This license grant to us, and terms above regarding any applicable moral rights, survive any termination of this EULA and shall in-ure to the benefit of us.
USER SUGGESTIONS
If you come to us with a suggestion for our Game, that suggestion is made for free and we have no obligation to accept or consider it. We can use or not use your suggestion in any way we want and we do not have to pay you for it. If you think you have a suggestion that we would be willing to pay for, please do not submit your suggestion unless you have first told us you expect to be paid and we have responded in writing by asking you to submit the suggestion.

USER ACCOUNT
In order to use the Game or for certain features of the Game to work properly, you may be required to have and maintain a valid and active user account with an online service, such as a third-party gaming platform or social network account (“Third Party Account”). If you do not maintain such accounts, then certain features of the Game may not operate or may cease to function properly, either in whole or in part. It might also be required for the User to create a Game specific account with us (“User Account”) in order to access the Game and its functionality and features. You are responsible for all the use and the securi-ty of your User Account and any Third Party Accounts that you use to access and utilize the Game.
THIRD-PARTY GAMING PLATFORM
This EULA and the provisions of the Game are subject to the additional terms and condi-tions set forth in or required by the third-party gaming platform from which the Game is accessed, and where applicable and consistent with our intent, such applicable terms and conditions are incorporated herein by this reference. We are not responsible or liable to you for any credit card or bank-related charges or other charges or fees related to your purchase transactions through the third-party gaming platform. All such transactions are administered by the third-party gaming platform, not us. We expressly disclaim any liabil-ity for such transactions, and you agree that your sole remedy regarding all transactions is through such third-party gaming platform, not us.
This EULA is solely between you and us. You acknowledge that the third-party gaming platform may not have an obligation to furnish any maintenance or support services to you in connection with the Game. Except for the foregoing, to the maximum extent permitted by applicable law, the third-party gaming platform shall have no other warranty obligation whatsoever with respect to the Game. Any claim in connection with the Game (e.g., related to product liability, a failure to conform to applicable legal or regulatory requirements, claims under consumer protection or similar legislation or intellectual property infringe-ment) are governed by this EULA. You must comply with the third-party gaming platform terms of service and any other third-party gaming platform applicable rules or policies. The license to the Game is a non-transferable license to use the Game only on an applicable device that you own or control.
UPDATES
We may make updates or patches (“Updates”) to the Game from time to time at our sole discretion. We are however not obligated to provide Updates or provide maintenance and support for the Game.

THE GAME IS PROVIDED ”AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EX-PRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR IN-FORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE GAME, INCLUDING WITHOUT LIMITA-TION THE SOFTWARE LICENSED TO YOU AND THE RESULTS OBTAINED THROUGH THE GAME. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF INFORMATION, PRODUCTS OR SER-VICES AND 2) ANY WARRANTIES OF TITLE, WARRANTY OF NON-INFRINGEMENT, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH THE GAME, INCLUD-ING WITHOUT LIMITATION THE USE OR INABILITY TO USE THE GAME.
TERM AND TERMINATION
This EULA is effective until terminated. We may terminate this EULA at any time if you breach our terms, or if we believe that termination is necessary for any other reason. You can also terminate this EULA at any time by uninstalling the Game and by removing any copies of the Game. Upon termination, you will no longer enjoy the rights given to you in this EULA, and you must immediately stop using the Game and delete all copies of the Game. The provisions that by their nature continue and survive any termination of this EULA shall continue to apply after termination of this EULA.
GOVERNING LAW AND DISPUTES
This EULA shall be governed by and construed in accordance with the laws of Sweden. In the event any dispute was to arise between you and us, such dispute shall be finally settled by arbitration in accordance with the Arbitration Rules for Expedited Arbitrations of the Arbitration Institute of the Stockholm Chamber of Commerce. The seat of arbitration shall be Gothenburg, Sweden. The language of the arbitration shall be English.
AMENDMENTS
From time to time, we may make changes to this EULA. This could be due to changes in the Game, changes in how we do things or changes of our legal obligations. From the time of the change, it will be effective to the extent it is legally applicable. We will inform you of any changes to this EULA by using reasonable means at our disposal.
