1. License Grant: Trippy Gamestudio ("We" or "Us") grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the game "The Trip" (the "Software") solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
2. Restrictions: You agree not to, and you will not permit others to:
a. License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Software or make the Software available to any third party.
b. Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Software.
c. Remove, alter, or obscure any proprietary notice (including copyright and trademark notices) on any part of the Software.
3. Intellectual Property Rights: You acknowledge that we own all rights, title, and interest, including all related intellectual property rights, in and to the Software. This Agreement does not transfer to you any rights, title, or interest in or to the Software, except for the limited license granted above.
4. User Content: If the Software allows you to create, post, or share content, you grant Us a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such content for any purpose.
5. Disclaimer of Warranties: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE IS AT YOUR SOLE RISK. THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
6. Limitation of Liability: IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE.
7. Termination: This Agreement is effective until terminated by you or Us. Your rights under this Agreement will terminate automatically without notice from Us if you fail to comply with any term(s) of this Agreement. Upon termination of the Agreement, you shall cease all use of the Software and delete all copies of the Software from your devices.
8. Governing Law: This Agreement will be governed by the laws of Ireland, without regard to its conflict of laws principles.
9. Amendments to this Agreement: We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
By using "The Trip," you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
