End User License Agreement (EULA)

PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE INSTALLING, ACCESSING, OR USING THE GAME. BY INSTALLING, ACCESSING, OR USING THE GAME, YOU AGREE TO BE BOUND BY THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL, ACCESS, OR USE THE GAME.
1. Introduction
This End User License Agreement ("EULA") is a legal agreement between you (either an individual or an entity) and Dream on a Stick Limited ("Company") for the software application, KOPI ("Game"), including any associated media, printed materials, and online or electronic documentation.
2. Grant of License
The Company grants you a non-exclusive, non-transferable, limited right and license to install, access, and use one copy of the Game on a single device for your personal, non-commercial use, subject to the terms of this EULA.
3. Restrictions
You shall not:
- Copy, distribute, or reproduce the Game, except as expressly permitted by this EULA.
- Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game, except to the extent such acts are permitted by applicable law notwithstanding this limitation.
- Remove, alter, or obscure any proprietary notices or labels on the Game.
- Rent, lease, sublicense, sell, distribute, or otherwise transfer the Game to any third party.
- Use the Game for any commercial purpose without the prior written consent of the Company.
4. Ownership
The Game is licensed, not sold. This EULA does not grant you any ownership rights in the Game. All rights, title, and interest in and to the Game, including all intellectual property rights, are and will remain the exclusive property of the Company and its licensors.
5. Updates and Patches
The Company may provide updates, patches, or other modifications to the Game at its discretion. These updates, patches, or modifications may be necessary for the continued use of the Game. You consent to receive such updates, patches, or modifications without additional notice.
6. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from the Company if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Game and destroy all copies of the Game in your possession or control.
7. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE GAME IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE GAME, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, licensors, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including, but not limited to, reasonable attorney's fees and costs) arising out of or in any way connected with your use of the Game or violation of this EULA.
10. Governing Law and Jurisdiction
This EULA shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in the United Kingdom to resolve any legal matter arising from this EULA or the use of the Game.
11. Miscellaneous
- Entire Agreement: This EULA constitutes the entire agreement between you and the Company concerning the Game and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and the Company.
- Severability: If any provision of this EULA is found to be invalid or unenforceable, the remainder of this EULA shall remain in full force and effect.
- No Waiver: The failure of the Company to enforce any right or provision of this EULA shall not constitute a waiver of such right or provision.
