This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Orbital Flag Studio ("Company," "We," or "Us") for the software product "The Stellar Station Engineer" ("Software" or "Game"). By installing, copying, or otherwise using the Software, You agree to be bound by the terms of this Agreement. If You do not agree to the terms of this Agreement, do not install or use the Software.
**1. License Grant**
Orbital Flag Studio grants You a non-exclusive, non-transferable, revocable license to use the Software for your personal, non-commercial use, subject to the terms and conditions set forth in this Agreement.
**2. Ownership**
The Software is licensed, not sold. This Agreement does not convey to You any ownership interest in the Software. All right, title, and interest in and to the Software, including any updates, modifications, or enhancements, are and will remain the exclusive property of Orbital Flag Studio.
**3. Restrictions**
You agree not to:
- Copy, modify, or distribute the Software.
- Reverse engineer, decompile, or disassemble the Software, except to the extent that such activity is expressly permitted by applicable law.
- Remove, alter, or obscure any proprietary notices or labels on the Software.
- Use the Software for any unlawful purposes or in a manner inconsistent with this Agreement.
**4. Updates**
Orbital Flag Studio may provide updates, upgrades, or patches for the Software from time to time. These updates may be provided to You automatically or manually and are subject to the terms of this Agreement unless accompanied by a separate license agreement.
**5. Termination**
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if You fail to comply with any term(s) of this Agreement. Upon termination, You must cease all use of the Software and destroy all copies, full or partial, of the Software.
**6. Disclaimer of Warranties**
The Software is provided "AS IS" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. Orbital Flag Studio does not warrant that the Software will be uninterrupted or error-free, that defects will be corrected, or that the Software is free of viruses or other harmful components.
**7. Limitation of Liability**
In no event shall Orbital Flag Studio be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, business interruption, loss of information, or any other pecuniary loss) arising out of the use of or inability to use the Software, even if Orbital Flag Studio has been advised of the possibility of such damages.
**8. Governing Law**
This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.
**9. Entire Agreement**
This Agreement constitutes the entire agreement between You and Orbital Flag Studio regarding the use of the Software and supersedes all prior or contemporaneous understandings regarding such subject matter.
