This End User License Agreement (hereinafter referred to as the "Agreement") is a legal agreement between you (hereinafter referred to as the "User") and the developer Noral Creative (hereinafter referred to as the "Developer") regarding the video game "Beyond The Earth" (hereinafter referred to as the "Game"). By installing or playing the Game, the User confirms that they have read, understood, and agree to comply with the terms of this Agreement.
1. GRANT OF LICENSE
1.1. License. The Developer grants the User a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game for personal, non-commercial purposes only.
1.2. Restrictions. The User may not:
modify, decompile, disassemble, or reverse-engineer the Game, except where permitted by law;
copy, distribute, rent, sublicense, or otherwise transfer the Game to third parties;
use the Game for commercial purposes without prior written consent from the Developer.
2. OWNERSHIP
2.1. Intellectual Property. All rights to the Game, including but not limited to its code, design, characters, graphics, sound effects, and music, are owned by the Developer and are protected by international copyright and intellectual property laws.
2.2. Modifications. The User is prohibited from creating modifications, add-ons, or derivative works based on the Game without written permission from the Developer.
3. USE OF CONTENT
3.1. User-Generated Content. The User may create user-generated content (such as modifications, screenshots, and video recordings of gameplay) provided such content is for non-commercial use, does not infringe on the Developer's intellectual property, and does not harm the reputation of the Game.
3.2. Streaming and Publishing. The User is permitted to create and publish gameplay videos and live streams (e.g., on YouTube, Twitch, and other platforms) as long as they adhere to the Developer's copyright guidelines.
4. LIABILITY
4.1. Limitation of Liability. The Game is provided "as is" without any warranties, express or implied. The Developer is not liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the Game.
4.2. Support. The Developer is not obligated to provide technical support or updates for the Game but reserves the right to do so at its discretion.
5. PRIVACY
5.1. Data Collection. The Developer may collect and process personal data provided by the User in connection with the use of the Game, in accordance with the Developer’s privacy policy.
6. TERMINATION OF LICENSE
6.1. Termination. The license may be terminated by the Developer at any time in the event of the User’s violation of the terms of this Agreement. Upon termination, the User must immediately delete all copies of the Game from their devices.
6.2. Automatic Termination. This Agreement will automatically terminate if the User violates any terms related to the use of the Game as described herein.
7. CHANGES TO THE AGREEMENT
7.1. The Developer reserves the right to amend the terms of this Agreement at any time. Amendments will take effect upon publication on the official Game website or Steam store page. Continued use of the Game after changes are made signifies the User’s acceptance of the updated terms.
8. GOVERNING LAW
8.1. This Agreement is governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict of laws principles. All disputes arising out of or in connection with this Agreement shall be subject to the jurisdiction of the courts located at the Developer’s location.
9. MISCELLANEOUS
9.1. Severability. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9.2. Entire Agreement. This Agreement constitutes the entire agreement between the User and the Developer regarding the use of the Game and supersedes all prior agreements.
