End User License Agreement (EULA) for Pug'llector

This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Boreal View Studio ("Developer") for the software product Pug'llector ("Game"), which includes computer software and may include associated media, printed materials, and "online" or electronic documentation.
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
1. GRANT OF LICENSE
Boreal View Studio grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Game solely for your personal, non-commercial purposes strictly in accordance with the terms of this EULA.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Restrictions: You may not (a) copy, modify, or distribute the Game for any purpose; (b) transfer, sublicense, lease, lend, rent, or distribute the Game or any portion thereof to any third party; (c) reverse engineer, decompile, or disassemble the Game, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation; (d) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Boreal View Studio or its affiliates, partners, suppliers, or the licensors of the Game.
Updates: Boreal View Studio may from time to time provide enhancements or improvements to the features/functionality of the Game, which may include patches, bug fixes, updates, upgrades, and other modifications ("Updates"). Updates may modify or delete certain features and/or functionalities of the Game. You agree that Boreal View Studio has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the Game to you. You further agree that all Updates will be deemed to constitute an integral part of the Game and shall be subject to the terms and conditions of this EULA.
3. TERMINATION
This EULA is effective from the date you first use the Game and shall continue until terminated. You may terminate it at any time upon written notice to Boreal View Studio. It will also terminate immediately if you fail to comply with any term of this EULA. Upon such termination, the licenses granted by this EULA will immediately terminate and you agree to stop all access and use of the Game. The provisions that by their nature continue and survive will survive any termination of this EULA.
4. INTELLECTUAL PROPERTY RIGHTS
The Game and all rights, title, and interest in and to the Game, including without limitation any modifications, enhancements, derivatives, and/or Updates thereto, are and shall remain the exclusive property of Boreal View Studio.
5. DISCLAIMER OF WARRANTIES
You expressly acknowledge and agree that use of the Game is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy, and effort is with you. To the maximum extent permitted by applicable law, the Game is provided "as is" and "as available", with all faults and without warranty of any kind, and Boreal View Studio hereby disclaims all warranties and conditions with respect to the Game, either express, implied, or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, and of non-infringement of third-party rights.
6. LIMITATION OF LIABILITY
To the extent not prohibited by law, in no event shall Boreal View Studio be liable for personal injury, or any incidental, special, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use or inability to use the Game, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if Boreal View Studio has been advised of the possibility of such damages.
7. MISCELLANEOUS
If any provision of this EULA is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and the remaining provisions of this EULA shall remain in full force and effect. This EULA constitutes the entire agreement between you and Boreal View Studio with respect to the use of the Game and supersedes all prior or contemporaneous understandings regarding such subject matter.
