ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE
THIS IS A LEGAL AGREEMENT BETWEEN YOU ("USER" OR "YOU") AND Indevelopment Productions ("Indevelopment Productions"). BY COMPLETING THE REGISTRATION PROCESS, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. The Online Service ("Service") is provided to you ("User") under the following Indevelopment Productions terms ("Terms"). The Terms comprise the entire agreement between User and Indevelopment Productions and supersede all prior agreements between the parties regarding the subject matter contained herein.
CONDITIONS OF USE
You are solely responsible for the content of all data You store or retrieve from, or attempt to store or retrieve from, Your Account. Your use of the Service is subject to all applicable local, state, national and international laws and regulations. You will: (a) not use the Service for any illegal purposes; (b) not use the Service to store, retrieve, transmit or view any file, data, image or program that contains: (i) any illegal pictures, materials or information; (ii) any harassing, libelous, abusive, threatening, harmful, vulgar, pornographic, obscene or otherwise objectionable material of any kind or nature; (iii) any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation; (iv) any code or material that violates the intellectual property rights of others; (v) any Windows temporary files of any kind (luding, without limitation, any *.p or ~*.* files); or (vi) any viruses, worms, "Trojan horses" or any other similar contaminating or destructive features; (c) comply with United States and other applicable law regarding the exportation and re-exportation of any data or other materials from the United States or other jurisdictions through the Service; (d) not use the Service for any spamming, chain letters or other use that may otherwise disrupt the Service or the networks through which You access and use the Service; (e) comply with all regulations, policies and procedures of networks through which You access and use the Service; and (f) not access or attempt to access any Service account for which You have no access authorization or duplicate, modify, distribute or display any of the data or files from any such account.
MODIFICATIONS TO SERVICE
Indevelopment Productions reserves the right to modify or discontinue the Service with or without notice to User. Indevelopment Productions shall not be liable to User or any third party should Indevelopment Productions exercise its right to modify or discontinue the Service.
DISCLAIMER OF WARRANTIES
USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT USER'S SOLE RISK. ALTHOUGH Indevelopment Productions WILL ATTEMPT TO PROVIDE UNINTERRUPTED, TIMELY, AND SECURE SERVICES, Indevelopment Productions MAKES NO REPRESENTATION THAT IT WILL BE ABLE TO DO SO. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Indevelopment Productions EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, LUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Indevelopment Productions MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. USER UNDERSTANDS AND AGREES THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT USER'S OWN DISCRETION AND RISK AND THAT USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO USER'S COMPUTER \ SYSTEM OR LOSS OF DATA OR UNAUTHORIZED DISCLOSURE OF DATA THAT RESULTS FROM THE UPLOAD, DOWNLOAD OR STORAGE OF SUCH MATERIAL AND/OR DATA. Indevelopment Productions MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY USER FROM Indevelopment Productions OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
LIMITATIONS OF LIABILITY
NO RESALE OR COMMERCIAL USE OF THE SERVICE
User's right to use the Service is personal to User. User agrees not to resell or make any commercial use of the Service, without the prior express written consent of Indevelopment Productions.
INDEMNIFICATION
User agrees to indemnify and hold Indevelopment Productions, contractors, suppliers and its and their employees, harmless from and against any claim or demand, luding reasonable attorneys' fees, made by any third party due to or arising out of User's use of the Service, the violation of these Terms by User, or the infringement by User, or other user of the Service using User's computer, of any intellectual property or other right of any person or entity.
