END USER LICENSE AGREEMENT (EULA)
For the video game Tomorrow's Day
1. Acceptance of EULA
By installing, copying, or using all or any portion of the video game "Tomorrow's Day" (the "Game"), you agree to be bound by the terms of this End User License Agreement (the "Agreement"). If you do not agree to the terms of this Agreement, you are not authorized to install, copy, or use the Game.
2. License
SPLENDEED® grants you a non-exclusive, non-transferable license to use the Game on a limited number of devices that you own or control, solely for your personal, non-commercial use, subject to the terms of this Agreement.
3. License Restrictions
You are not permitted to:
Modify, translate, adapt, or otherwise create derivative works of the Game;
Rent, lease, redistribute, or sublicense the Game to a third party;
Reverse engineer, decompile, or disassemble the Game, except to the extent expressly permitted by applicable law notwithstanding this limitation;
Remove or alter any copyright notices, trademarks, or other proprietary notices included in or accompanying the Game.
4. Ownership
The Game is protected by copyright and other intellectual property laws and treaties internationally. SPLENDEED® and its licensors own all rights, titles, and interests in and to the Game, including, but not limited to, all intellectual property rights.
5. Limited Warranty
SPLENDEED® warrants that the medium on which the Game is distributed will be free from defects in material and workmanship under normal use for a period of ninety (90) days from the date of purchase. This limited warranty is void if failure has resulted from accident, abuse, or misapplication.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall SPLENDEED® be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Game, even if SPLENDEED® has been advised of the possibility of such damages.
7. Termination
This Agreement is effective until terminated. You may terminate this Agreement by deleting all copies of the Game in your possession. SPLENDEED® may terminate this Agreement at any time if you fail to comply with the terms and conditions set forth herein, in which case you must destroy all copies of the Game.
8. General
This Agreement constitutes the entire agreement between you and SPLENDEED® regarding the use of the Game and supersedes all prior or contemporaneous understandings and agreements, whether electronic, oral, or written, between the user and SPLENDEED®.
9. Governing Law
This Agreement shall be governed by the laws of [your country/jurisdiction], without regard to principles of conflict of laws.
