END USER LICENSE AGREEMENT (EULA)

IMPORTANT: READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE INSTALLING OR USING THIS GAME.
This End User License Agreement ("Agreement") is a legal contract between you ("User" or "Licensee") and Skysmith Studios Pvt. Ltd. ("Licensor" or "Skysmith Studios") for the game Ground Water - Episode of Dhanra ("Game").
By clicking the "I AGREE" button below, or by otherwise continuing to install, download, copy, access, or use the Game, you acknowledge that you understand and agree to be bound by the terms of this EULA. If you do not agree, you must select the "I DON'T AGREE" button and you may not continue to install, download, copy, access, or use the Game.
1. License Grant
Licensor grants you a non-exclusive, non-transferable license to install and use the Game on a single device for personal, non-commercial use, subject to the terms of this Agreement. You may not install or use the Game on multiple devices.
2. Ownership
All rights, title, and interest in and to the Game, including any updates, patches, and related materials, are owned by Licensor. This Agreement does not grant you any ownership rights in the Game.
3. Copyright
All content in the Game, including but not limited to artwork, music, soundtracks, characters, character designs, storylines, and code, is the intellectual property of Skysmith Studios Pvt. Ltd. and is protected by copyright laws and international treaties. You may not reproduce, distribute, or create derivative works based on any of the copyrighted materials without the express written permission of Licensor. Any unauthorized use of the Game or its content constitutes infringement and may result in legal action.
4. Trademarks
All trademarks, service marks, and trade names related to the Game, including but not limited to "SKYSMITH STUDIOS" and "GROUND WATER - THE GAME," are the property of Licensor. You may not use any trademarks without the prior written consent of Licensor.
5. Restrictions
You may not:
- Modify, decompile, disassemble, or reverse engineer the Game.
- Distribute, sell, or rent the Game to any third party, except that you may sell your copy of the Game provided that you retain no copies of the Game in any form after the sale.
- Use the Game for any unlawful purpose or in violation of any applicable laws.
- Remove or alter any copyright, trademark, or other proprietary notices contained in the Game.
6. User Content
If the Game allows you to create, upload, or share content, you grant Licensor a worldwide, royalty-free, non-exclusive license to use, reproduce, and display such content in connection with the Game. You represent that you own or have the necessary rights to any content you submit.
7. Termination
This Agreement is effective until terminated. Licensor may terminate this Agreement if you fail to comply with any term or condition. Upon termination, you must cease all use of the Game and destroy all copies in your possession.
8. Disclaimer of Warranties
The Game is provided "as is" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Licensor does not warrant that the Game will be error-free or uninterrupted.
9. Limitation of Liability
To the fullest extent permitted by law, Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Game, even if Licensor has been advised of the possibility of such damages.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
11. Indemnification
You agree to indemnify, defend, and hold harmless Licensor, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Game or your violation of this Agreement.
12. Export Control
You agree to comply with all applicable export control laws and regulations. You represent that you are not located in a country that is subject to an embargo or that has been designated by the government as a "terrorist supporting" country. You also represent that you are not listed on any U.S. government list of prohibited or restricted parties.
13. Severability
If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of this Agreement shall remain in full force and effect.
14. No Waiver
The failure of Licensor to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.
15. Entire Agreement
This Agreement constitutes the entire understanding between you and Licensor regarding the Game and supersedes all prior agreements, whether written or oral, concerning the subject matter herein.
