End User License Agreement
This End User License Agreement (hereinafter referred to as "EULA") is a contract between you and Ausuc Games, located in Japan. This license applies to the software product and all related documentation (manuals, packaging), regardless of whether they are accessed in print, file, download, or online form, and extends to any updates or upgrades that supplement the software unless distributed as a separate license (hereinafter collectively referred to as the "Software").
This Software is licensed, not sold. By installing or using the Software, you agree that you have read this EULA and agree to be bound by the terms and conditions defined in this agreement. If you do not agree to the terms of this EULA, you may not install or use the Software.
The Software is protected by international treaties on intellectual property and domestic copyright laws.
License
In accordance with this EULA, Ausuc Games grants you a non-exclusive, limited license to install and use the Software solely for personal, non-commercial purposes on a single computer or other gaming device (depending on the type of operating system the Software is designed for). Sharing the Software, installing it on multiple computers or gaming devices simultaneously, or installing it on a network is not permitted.
Ausuc Games is only granting you a license to use the Software, and no intellectual property rights, titles, or ownership of the Software are transferred to or assigned to you. Ausuc Games retains all rights (including but not limited to copyright, other intellectual property rights, and trademarks) related to the Software and its components, especially any part of the Software that may be considered a separate creation, as well as its related materials. Any rights not expressly granted to you under this EULA are retained by Ausuc Games.
This EULA will immediately terminate if you attempt to circumvent any technical protection measures related to the Software.
Restrictions
The following rights are not permitted: (a) Using the Software for commercial purposes, i.e., purposes that directly or indirectly generate economic benefits; (b) Distributing, sublicensing, lending, leasing, or transferring the Software to third parties, except as expressly provided in this agreement; (c) Installing, using, or allowing access to the Software on a network or installing the Software on multiple computers or gaming devices simultaneously; (d) Circumventing technical protection measures used to prevent illegal use or copying of the Software or its features; (e) Reverse engineering, decompiling, disassembling, creating derivative works, or modifying the Software; (f) Removing or altering any trademarks, logos, or other notices included in the Software.
If you violate any of the provisions defined under "License" or "Restrictions," Ausuc Games reserves the right to terminate this EULA after 14 days' notice and/or pursue any rights permitted under applicable law. This EULA will terminate immediately if you attempt to circumvent any technical protection measures related to the Software. Upon termination of this EULA, you must permanently uninstall and delete the Software and any copies thereof.
Limited Warranty
Ausuc Games guarantees that the Software is compatible with the personal computer or other gaming devices that meet the minimum system requirements described in the Software documentation. While the Software has been tested, Ausuc Games does not guarantee that the Software will not interfere with third-party software or drivers installed on your computer. Such interference may prevent the Software from functioning properly or even prevent it from starting. If a defect is found in the Software you own, Ausuc Games will allow you to download a replacement from the server. No support for the Software is provided under this license. The Software is provided "as is."
Limitation of Liability
Subject to the "Consumer Rights" section, Ausuc Games shall not be liable for any damages arising from the use of or inability to use the Software, whether direct or indirect, regardless of their nature, including special, incidental, or consequential damages. This includes, but is not limited to, lost profits, hardware or software damage, work stoppages, or malfunctions. Specifically, this means that Ausuc Games' liability under this agreement is excluded to the maximum extent permitted by law, regardless of whether it is based on tort or any other legal theory.
Consumer Rights
Depending on the laws of your region, certain consumer rights may be recognized that cannot be excluded by this EULA. In the event of a conflict between this EULA and the consumer rights provided by law, such rights shall prevail, subject to the following limitations: You acknowledge and accept responsibility for the security of data stored on the computer you are using. You should regularly create backup copies of your important data and avoid running multiple programs simultaneously, which could lead to data loss or work loss due to potential interference between programs. Ausuc Games is not responsible for data loss resulting from this.
Final Provisions
This EULA shall be governed by the laws of Japan. This agreement contains all the agreements between the parties and supersedes all prior agreements, whether written or oral, within the scope of this agreement.
