End-User License Agreement (EULA)
PLEASE READ THIS END-USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE USING "ROGUE BATTALION."
By downloading, installing, or using "Rogue Battalion" ("the Game"), you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the Game.
1. License Grant
Zappy Turtle ("Licensor") grants you ("Licensee") a non-exclusive, non-transferable, revocable license to download, install, and play the Game solely for your personal, non-commercial use, subject to the terms and conditions of this EULA.
2. Restrictions
You agree not to:
Copy, distribute, or sublicense the Game, except as expressly permitted by this EULA.
Reverse-engineer, decompile, disassemble, or create derivative works based on the Game.
Use the Game for any commercial purpose or public performance.
Modify, hack, or cheat within the Game.
Use the Game in any manner that violates applicable laws or regulations.
3. Ownership
All intellectual property rights in and to the Game, including but not limited to its software, content, and trademarks, are owned by Zappy Turtle or its licensors. This EULA does not grant you any ownership rights.
4. User-Generated Content
If the Game allows for user-generated content, you grant Zappy Turtle a worldwide, royalty-free, non-exclusive license to use, modify, reproduce, distribute, and display your content in connection with the Game. You represent that you own or have the necessary rights to your content.
5. Privacy
Zappy Turtle may collect and process data related to your use of the Game. By using the Game, you consent to such data collection and processing.
6. Updates and Changes
Zappy Turtle may update or modify the Game at its discretion, including patches or new features. This EULA applies to any updates unless the update includes a separate license.
7. Termination
This EULA is effective until terminated. Zappy Turtle may terminate this EULA immediately if you violate its terms. Upon termination, you must delete all copies of the Game in your possession.
8. Disclaimers and Limitation of Liability
The Game is provided "AS IS" without warranties of any kind, express or implied.
Zappy Turtle is not liable for any damages arising from your use of or inability to use the Game, including but not limited to data loss, financial loss, or any indirect or consequential damages.
9. Governing Law
This EULA is governed by the laws of Utah, USA, without regard to its conflict of law principles. Any disputes arising under this EULA shall be resolved exclusively in the courts of Utah, USA.
10. Miscellaneous
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This EULA constitutes the entire agreement between you and Zappy Turtle regarding the Game and supersedes any prior agreements.
