END USER LICENSE AGREEMENT (EULA)

Effective Date: October 17, 2024
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Mrsmithentop ("Developer" or "We") for the use of the software application known as Scope 3 ("Software"). By installing, accessing, or using the Software, You agree to be bound by the terms of this Agreement. If You do not agree to the terms, do not install, access, or use the Software.
1. License Grant
You are not purchasing the Software itself, but a limited, non-exclusive, non-transferable, and revocable license to install, use, and enjoy the Software for personal or business purposes. The Software remains the property of Mrsmithentop at all times. This license is subject to the terms of this Agreement.
2. Prohibited Actions
You agree that You will not:
Attempt to break into, hack, reverse-engineer, decompile, disassemble, or otherwise modify the Software.
Steal or extract any proprietary data, code, or assets from the Software.
Modify any part of the Software or its components without explicit written permission from Mrsmithentop.
3. Rights and Ownership
You own a license to use the Software for personal or business purposes, but You do not own the Software itself. All rights, title, and interest in and to the Software, including but not limited to the code, graphics, and intellectual property, remain with Mrsmithentop.
This Agreement grants You the right to use the Software within the terms provided, but it does not allow for actions such as modifying, reverse-engineering, or reselling the Software, except as explicitly permitted by applicable law or this Agreement.
4. Breach of Agreement
Any breach of this Agreement, including but not limited to modifying, decompiling, or attempting to steal from the Software, will result in the immediate termination of Your license. Upon termination, You will lose access to the Software, and We reserve the right to take any further actions necessary.
5. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if You fail to comply with its terms. Upon termination, You must immediately cease all use of the Software and delete all copies of the Software in your possession.
6. Disclaimer of Warranty
The Software is provided "as-is" without any warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Mrsmithentop does not guarantee that the Software will be free of defects, uninterrupted, or error-free.
Mrsmithentop shall not be responsible for any damage or issues that arise from the use of the Software. If the Software causes any problems on your computer or other devices, the only recourse You will have is through Steam’s support system. Mrsmithentop's liability is limited to whatever remedies Steam support may offer.
7. Limitation of Liability
Mrsmithentop is not liable for any direct, indirect, incidental, or consequential damages that may arise from the use or inability to use the Software, including but not limited to data loss, hardware damage, or interruption of service. By agreeing to these terms, You waive any right to claim damages beyond those provided by Steam.
In no event shall Mrsmithentop be held responsible for any claims, damages, or liabilities that exceed the amount paid for the license to use the Software.
If You identify any vulnerabilities or issues, it is recommended (though not required) to contact the developer so that the Software can be updated. Mrsmithentop strives to create a safe product and appreciates any feedback to improve the Software.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the USA. Any disputes arising under or related to this Agreement shall be resolved exclusively in the courts of the USA.
9. Entire Agreement
This Agreement constitutes the entire agreement between You and Mrsmithentop regarding the use of the Software and supersedes any prior understandings.
By using the Software, You acknowledge that You have read, understood, and agreed to be bound by the terms of this Agreement.
