YOU SHOULD CAREFULLY READ THE FOLLOWING END USER LICENSE AGREEMENT (EULA) BEFORE INSTALLING THIS SOFTWARE PROGRAM. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY REMOVE THE SOFTWARE PROGRAM FROM YOUR SYSTEM.
License: Ozapell grants you the right to use the enclosed program (the "Software"). You will not use, copy, modify, rent, sell, or transfer the Software or any portion thereof except as provided for in this Agreement.
RESTRICTIONS: You WILL NOT:
1. Sublicense the Software;
2. Reverse engineer, decompile, or disassemble the Software;
3. Copy the Software except as provided in this Agreement;
4. Permit simultaneous use of the Software by more than one user.
Software: Ozapell hereby grants to you the right to use the software (including Open Beta or Early Access) on your personal computer. You agree to indemnify Ozapell and its affiliates against any loss, liability or expense (including reasonable legal fees) arising out of or in connection with the use, misuse, marketing, licensing or sale of the software or the maintenance, support or other services or activities related thereto. Software also includes any part of the Software labeled as "unregistered", "beta", "early access", "experimental", "example", "trial", or "demo".
NO WARRANTY; NO LIABILITY FOR DAMAGES: THE SOFTWARE IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND INCLUDING WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, NONINFRINGEMENT OF THIRD-PARTY INTELLECTUAL PROPERTY, OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT SHALL OZAPELL BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DIRECT OR INDIRECT DAMAGES, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF OZAPELL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Without limiting the generality of the foregoing, no warranty is made that the Software will generate computer programs with the characteristics or specifications desired by you or that the Software will be error-free. THESE DISCLAIMERS OF WARRANTY CONSTITUTE AN ESSENTIAL PART OF THIS AGREEMENT.
U.S. GOVERNMENT RESTRICTED RIGHTS: The Software and documentation are provided with "RESTRICTED RIGHTS." Use, duplication, or disclosure by the Government is subject to restrictions as set forth in FAR54-227-14 and DFAR252-227-7013 et seq or its successor. Use of this Software by the Government constitutes acknowledgment of Ozapell's proprietary rights in the Software.
OWNERSHIP AND COPYRIGHT OF SOFTWARE: Title to the Software and all copies thereof remain with Ozapell or its vendors. The Software is copyrighted and is protected by United States copyright laws and international treaty provisions. You will not remove the copyright notice from the Software. You agree to prevent any unauthorized copying of the Software.
GENERAL TERMS THAT APPLY TO SOURCE CODE FILES
You may develop and edit your own source code files using the Software. You may reproduce and distribute source code files which you create using the Software without additional license or fees, subject to all of the conditions in this statement.
I hereby acknowledge that I have read and understand the foregoing License Agreement and agree that the action of installing the Program is an acknowledgment of my agreement to be bound by the terms and conditions of the License Agreement contained herein. I also acknowledge and agree that this License Agreement is the complete and exclusive statement of the agreement between Ozapell and I and that the License Agreement supersedes any prior or contemporaneous agreement, either oral or written, and any other communications between Ozapell and myself.
