This document contains the terms and conditions of the license of TRIDENT'S WAKE video game, owned by BACUS STUDIOS.
All matters related to the use of the video game, the license scope and limits in favor of the User, the proper warranties, and the liabilities between the User and BACUS STUDIOS shall be resolved pursuant to the conditions established in this document. This document is supplemented by the Terms and Conditions and the Privacy Policy of TRIDENT'S WAKE, available on .
1. User or Licensee
You have become the User or Licensee of TRIDENT'S WAKE due to the downloading and installation of the software. As User of the software, you shall comply with all terms and conditions of this license in order to consider the use of the video game as authorized or legal. Any use of TRIDENT'S WAKE which violates any regulation of this license shall entail the immediate loss of all rights hereby vested, turning any future use of this video game to illegal.
The downloading, installation or installation attempt of TRIDENT'S WAKE shall imply that the User knows and accepts the Terms and Conditions, as well as the BACUS STUDIOS Privacy Policy, available on .
Any user not willing to accept, agree or comply with the conditions or Privacy Policy herein established shall not have authorization to use TRIDENT'S WAKE and shall desist from installing or using the video game.
2. User's Legal Capacity
Only users who are able to consent their entering into agreements pursuant to the valid legislation of their place of residence shall have the right to use TRIDENT´S WAKE. In the Argentine Republic, this capacity is acquired at the age of fourteen (14). In case of acting as legal representative of a legal entity, the user shall have powers to act on behalf of the legal entity and to enforce it to comply with the terms and conditions herein established. If the user does not have the aforementioned powers or takes advantage of them, it shall be understood that he/she is also personally committed to the terms and conditions.
3. TRIDENT´S WAKE Software
TRIDENT´S WAKE software is a twin stick shooter video game owned by BACUS STUDIOS, created for its downloading and installation in supporting PCs (Windows.) TRIDENT´S WAKE is a single player video game. However, it allows the simultaneous participation up to three players per game in cooperative mode.
The necessary hardware requirements to correctly use TRIDENT´S WAKE are available on . The user accepts that online games and, in particular, the necessary operating system specifications in order to use these games, can change through time. Consequently, BACUS STUDIOS reserves the right to modify and/or add the necessary operating system specifications to install TRIDENT´S WAKE, at any time and without prior notice.
The user shall be the sole responsible for configuring the technical applicable requirements for the use of TRIDENT´S WAKE in his/her computer or personal console as well as their maintenance.
4. Grant of License
The license herein vested establishes rights and privileges for the use of TRIDENT'S WAKE video game to the User's benefit, as detailed onwards. These rights and privileges set the framework in which the use of the video game shall be considered as authorized and legal. BACUS STUDIOS grants the USER a personal, non-exclusive, revocable, non-transferable, non-commercial and limited time framed license for the installation of TRIDENT'S WAKE and for the User's private use, according to the terms and conditions hereby established.
4.1 Terms and Scope of the License
The license granted by BACUS STUDIOS authorizes the installation of one (1) copy of the video game in the User's compatible device (1.) The User shall only make private use of the video game. The User shall not use the video game in benefit of third parties under any circumstances, neither receiving or not a compensation in a direct or indirect way, nor having the third party the video game available or not. For the purposes herein contained, there is use of the video game in benefit of third parties when they use it, even when there is no direct profit taken by them or by the User; when TRIDENT'S WAKE is commercially distributed or
used to render services to third parties; or when it is part of services or products offering, unless there is a previous written authorization by BACUS STUDIOS.
This License authorizes the use of the video game for personal entertainment and not for taking profit of it. In accordance with these terms and conditions, the User agrees to use the product personally without:
a) Making reverse engineering, decompilation or disassembly of any part of TRIDENT'S WAKE or making derived works from it.
b) Deleting any TRIDENT'S WAKE ownership inscriptions, copyrights or marks.
c) Neither selling, loaning, transferring, sub licensing TRIDENT'S WAKE, assigning the rights herein acquired under any circumstances, nor allowing the copy or use of the software by any third parties.
d) Making non-authorized copies of TRIDENT'S WAKE.
e) Giving TRIDENT'S WAKE a use other than that specified by BACUS STUDIOS.
The violation of the aforementioned terms and conditions shall imply the expiry of the rights over the license and the user´s liabilities to immediately uninstall BACUS STUDIOS video game. Furthermore, the User shall be jointly and severally liable with third parties for any damages caused to BACUS STUDIOS or any third party.
5. Copyright
TRIDENT’S WAKE is part of a system integrated by a combination of programs or subsystems. These systems and subsystems are authorship and property of BACUS STUDIOS. They are registered under its name in the Dirección Nacional de Derecho de Autor (Argentine Copyright Department) and BACUS STUDIOS copyrights are internationally protected by the TRIPs agreement (Trade Related Aspects of Intellectual Property Rights), by the Berne Convention, and by WIPO treaties and provisions. TRIDENT’S WAKE video game, as well as all its constitutive elements that are individually considered, are intellectual property of BACUS STUDIOS. This Agreement does not assign any rights over the video game other than the pure authorization to its use in benefit of the User within the limits herein established. To this effect, all rights of TRIDENT’S WAKE are hereby reserved to BACUS STUDIOS.
6. TRIDENT’S WAKE Use Policy
BACUS STUDIOS does not exercise any control over the way in which TRIDENT’S WAKE is used. Consequently, the illegality in which the use of the video game may incur shall establish an incorrect use of TRIDENT’S WAKE. Illegal use, among others, makes reference to any use that may adversely affect a third party’s rights or that may be contrary to morals and good customs.
7. Liability Limitations
a) BACUS STUDIOS shall not be responsible, in a direct or indirect way, for any special or consequential losses or damages suffered by the User, his/her employees and/or his/her own clients that may arise or result from the video game downloading (including the data loss or alteration), regardless of the reason that may cause them and the type of liability. The User agrees that he/she is the sole responsible for: i) the configuration and requirements of the destination system; ii) the selection of the system, the third parties’ software and the tools in order to achieve the User’s intended results; iii) the use of the video game; iv) the video game obtained results; v) the (immediate or medium-term, direct or indirect) damages that the use of the video game may cause to the User or to third parties; vi) the indemnity of the User’s computer systems in which he/she may have installed the video game.
b) BACUS STUDIOS shall not be responsible neither for the total or partial loss of information, nor for the modification, removal or non authorized disclosure of information in the device in which TRIDENT’S WAKE is installed.
c) BACUS STUDIOS does not guarantee that TRIDENT’S WAKE video game works in a uninterrupted and stable way under all possible configurations and combinations of software. TRIDENT’S WAKE is offered as it is and without any kind of warranties.
d) BACUS STUDIOS does not guarantee neither that TRIDENT’S WAKE results innocuous for the hardware, operating system or any other software of the device in which the video game is installed, nor that any possible failure due to the installation of the software may be solved even after the desinstallation of the video game.
e) BACUS STUDIOS shall not be responsible for any damages suffered by the User that are caused in the different communication media and facilities provided by third parties.
f) BACUS STUDIOS shall not be responsible for any damages or losses suffered by the User as a result of a cyber-attack perpetrated by a third party.
g) BACUS STUDIOS shall not be responsible for losses, damages or any other direct, indirect or incidental harm that may be caused to third parties by the User due to the use of TRIDENT’S WAKE video game. The User shall be directly and inevitably responsible for any grievance, liabilities, action, cost, complaint, proceedings and/or damages that were applied to BACUS STUDIOS for the incorrect use of TRIDENT’S WAKE video game.
8. User STATEMENT
a) The User hereby agrees to use TRIDENT’S WAKE according to its normal and customary use, under the terms and conditions herein established or that shall be established by BACUS STUDIOS in the future.
b) The USER hereby agrees to use TRIDENT´S WAKE respecting all applicable laws under the jurisdiction where the software is installed including the terms and conditions on property rights, without limitations.
c) The USER hereby agrees to keep a regularly updated safeguard copy of every existent file in the device where TRIDENT´S WAKE is installed, in order to recover all data that may be affected by any cause.
9. License Termination
9.1 License Expiration
The expiration of the license shall be caused by:
1) The use of TRIDENT´S WAKE beyond the purposes under which the license is granted.
2) The failure to perform any of the terms and conditions herein established.
3) The use of TRIDENT´S WAKE with criminal, illegal, dysfunctional purposes which can act in detriment of third parties or are, somehow, forbidden by law.
In any case, arrears shall be considered as a matter of law, without prejudice. Notwithstanding with this fact, BACUS STUDIOS reserves the right to demand the USER to pay in order to regularize his/her situation.
9.2 License Suspension
The User accepts and acknowledges that BACUS STUDIOS shall temporarily suspend or permanently revoke the license of use, which has been granted under this agreement, without indication of reason and without generation of any rights of set-off in the USER´s benefit.
10. Personal details
In the process of downloading and/or installing the software, certain personal details may be required. All personal details given by the USER shall be governed by BACUS STUDIOS Privacy Policy.

Notifications and communications sent by BACUS STUDIOS to the user or sender e-mail address shall be considered as fully effective. Communication containing advertisement and inserted messages in TRIDENT´S WAKE, or sent during the provision of a service with the purpose of informing the users about a certain circumstance, shall likewise be considered effective.
12. Definitions
Software: It makes reference to the group of computer-controlled operations, documents, procedures and routines in a certain language or computer code with the purpose of directing the operations and processes of a computer or system to obtain certain data.
Use of the video game: The “Use” of the video game is known as the download and installation of the video game in a computer or compatible console. In the case of computers which are connected to a network, the “Use” is considered as a work station or computer with access to any of the functions of the video game at any moment. At any moment, the Licensee shall ensure that the number of competing uses of the video game does not exceed the uses authorized by BACUS STUDIOS.
BACUS STUDIOS and/or Licensor: BACUS STUDIOS is the sole holder of the Intellectual Property Rights related to the video game or any subsidiary material.
You and/or User: You and/or the user is the final User of the video game.
